i havent had the car for well over 30 days..but its been weird problems, like a lot of shit being backordered..i dont really care, im just pissed that i'm paying for a m3 convertible and i've been driving a 328 sedan for 30+ days..
That sucks. If I were you I'd go get my car back and tell them to call me when the parts are in. No sense in your M3 just sitting there because things are back-ordered (assuming its drivable). I'd also consider going elsewhere for service, as these "weird problems" might have something to do with that particular dealership and how it operates.

As far as I know, if you have the same problem 3 times (verifiable by the dealer as having a problem) then you qualify under the Lemon Law or if your vehicle is in the dealer more then 30 days in a the first 12 months. I believe, it doesn't matter what the problem is, even a minor issue as long as its repeated 3 times, or out of service for 30 days, which includes the time you had to wait for the backorder and installation. I would call a Lemon Law lawyer who can answer your questions in a matter of minutes. so a quick car history...i am leasing it, got it about 5 months ago, its been in the shop for lke 34 days or so. first the diff was making noise when i put it in reverse, then they scratch the car when they were fixing the diff, so they had to "detail it" then my idrive broke. it wouldn't go left. the part was on backorder, took 3 weeks to get it, got it back after 3 weeks, came back with scratches. had the car for a week, hit a pothole, then it went back to the dealer to replace a tire (i bought the tire warranty too) the tire was on backorder as well, took another 10 days to get the tire. i just got the car back (they detailed it again) but it has a few scratches on it again. its a black car, and the dealer was giving me a hard time about the scratches, but i straight up told them that if i brought back there rental with scratches like that, they would charge me, so how can they be ok with giving me my car back with scratches? they said they would wet sand the scratches out, which means i have to take the car back in another day to have it "fixed" what a pain in the ass. overall i've been out the car for WAY WAY WAY WAY WAY too long and i'm really upset about it.

^ agree, separate problems with separate visits. Being in for the tire and having to wait isnt a manufacturing problem, it was road hazard. You hit the pot hole causing the damage. The others are just dumb luck. I dont think you would qualify for it. You would probably have a better chance working something out with the dealer for compensation of some sort.
FWIW, I'd just ask the dealer not to bother washing/detailing the car at all. Were the scratches deep or just swirls in the clearcoat?
IMO the best you can do is get back the difference for one month's payment like I said. Only real problem that sounds like it can be lemon'ed would be the diff, but even so, that issue would have to occur a number of times. Sounds like they got it fixed the first time.

Can't lemon a car because you ran over a pothole and needed a new tire. That's not a manufacturer's defect. And I'm surprised they didn't just call a local tire shop or other dealer and buy the tire from them rather than wait 10 days for it to arrive (and surprised you didn't suggest it be done that way too!). That's ridiculous.

Lemon law would not apply in this case; however you can call up BMW NA and express your concerns about not having your car for almost 30+ days and thus get a refund or credit when you return the car.
