I forgot to mention my court case. This is a PSA for everyone based on my experience.

It's not every day you go to court. It's certainly not every day you listen to a guy perjure himself for half an hour and then have the judge rule in his favor.

The guy lied about what he was doing while in the car. He lied about why he was in a rental car. He said he wanted to buy a Challenger and rented one to test it out. He said he was in the passenger seat "fiddling with the visor" when I pulled up. He told me he had been in another accident earlier that week.

He lied that he was by himself and not a passenger in the car when his girlfriend/whatever was driving. He had his roommate perjure himself and say he was standing in line at the restaurant and saw that the guy's door was open 6" from 150 feet away inside the restaurant before I pulled into the spot, despite the fact that his back was to the parking lot as he was ordering food. And after seeing there had been an accident, the guy (who calls the plaintiff his 'brother') was so concerned he never came outside in the half an hour I was there with the police.

After all this, photos that show that only the leading edge of his door was damaged and that my car was damaged after the driver's mirror back to the end of the driver's door, and that in Maryland there's contributory negligence, the judge said, "Fuck it" and gave the guy $4,000 for hurting himself on my car. If I had done what he said, I would have ripped the door off the hinges.

So, here's the advice:

1. If your cellphone as a camera, take photos. Lots of them. Photograph the cars, photograph people, photograph anything that's around the cars. Photograph the street, the parking lot, the vantage points. Photograph any possible obstructions. Take a photo of the sky to show it was cloudy or raining or sunny.

2. Get names for anyone and everyone there. If you call the police, ask them to get the names of everyone in the other car.

3. Review the evidence and your story with your attorney. Then, put together a list of questions that you want asked/answered by the other side and review those with your attorney. Make your attorney tell you why they're irrelevant or legally inadmissible.

4. On the day of the trial, go over those questions again with your attorney. If you had to cull your list, make sure you have the new set of questions. Make sure your attorney asks them all to you during testimony. In the heat of the moment you'll be nervous and they might too (mine seemed so because she hadn't been in front of this judge before). That will help you both stay on track. If your attorney takes issue with this, find someone else.

5. Make sure that you go over those questions and the answers so that you're thorough in court. Once you get in there, the attorney probably isn't going to want to start side-barring every 20 seconds if the other party starts lying their ass off.

6. Make sure any photos you have show the proper depth and resolution of the damage prior to leaving the scene and definitely before it gets fixed.

7. If the Police refuse to do anything because no one is hurt, make sure that they put on the incident report that the other party reported no injuries.

I'm positive this guy was high. He reeked of pot. He wasn't paying attention and opened the door after I was in the space and hit me.

Because of mistakes my lawyer made (IMO oh-so-expert opinion) and my own inexperience I lost the case and now have to answer on any future deposition for an accident that I've been sued and lost if they ask.

And if by some fluke the guy that was in court with me is reading this: You lied to a judge in court. And you got your boy to perjure himself too. For $4,000. You suck.

Thanks. And thanks to everyone else too. It's from insurance but now I'm just another asshole that's gotten in an accident and caused someone damage. That makes me mad by itself.

I hope that my misfortunate helps anyone that finds themselves in this spot in the future. At least then it'll have been worth something

I still don't understand how any of that was your fault, Dave. It really doesn't make any sense.

Sorry to hear it didn't work out in your favor. That's completely asinine.

The fact that the other party flat-out lied would've enraged me. Hope karma comes back and introduces herself to that liar later on in life.

Sorry to hear again, CM. You deserve a nice Avant.

There are some secret TSBs (apparently) to address some of the issues I have with the Focus. I'm going to take it in and have them fix them. If they won't, then I'm back to looking for another car.

Part of me wishes I had low expectations. Most of the cars I want are at least $40K.

That's amateur advice Mike.

Majofo's advice:

Drop that motherfucker, kick his balls in, and eye gouge any dumb motherfucker around who could testify against you including their mothers.

Call insurance, claim your car was damaged while parked on the street.

Who wants to pitch in?

There are enough classics there that likely all of us will be with one at all times during the timeshare rotation.

Kimchi BRZ, you're not invited cuz you passed on an M3.

Well, with parity a thing of the past, my $1 is worth $0.75ish now. But, that gets us up to $1.75.

I'd invite CM but he's cursed and likely to crash/damage our dream cars...

Man Couldn't Steal C6 Vette Because He Can't Drive Stick

You hear about things like this happening from time to time, but the case involving this particular Florida car thief is particularly delightful. Here’s what happened: Annas Abdel-Khaliq nearly stole a 2012 Chevrolet Corvette Grand Sport while it was sitting in a service shop. He managed to get in and start the car up, but only drove 100 feet before his inability to drive a manual gearbox caught up with him.

this really looks bad. why would you have to be putting Chinese parts of any kind in a high end car like that, unless you were cheap assholes?

It was a sub-supplier. It may be that Aston got parts from someone in Surrey and those guys were scumbags and paid a company that has Chinese prison labor to build the parts.

You have a "high-end" Apple laptop/tablet/phone going around with parts...what's the big deal?

But, seriously...probably some underground thing going around that was not authorized by Aston Martin. Somebody's gonna get a hurt real bad for this. Somebody.

but don't you think that the mere fact that you are dealing with some company that could or would be involved in something like that would indicate that you are trying to find the cheapest stuff possible? i.e. in the opposite direction of where a car in that league should be sourced from.

and, a $100 iphone is not comparable to a $250k car in any way shape or form. Stuffing cheap Chinese parts in this thing in order to keep its cost ridiculously low considering what you are getting.
