need help with handling a "speeding" ticket

need help with handling a "speeding" ticket

TIA and i'll make this short
got off from work last night at midnight from a small town with no lights on their "highway" clocked for 56 on 45...
i told the officer it was dark and i did not noticed the sign and she said she will make it quick, ticket in 10 minutes.

technically i was speeding since i know i was over 45... but would not have done it if i saw the speed sign (last sign i saw was 60 coming out of the main city)

clean driving record... if i did speed on purpose sure i dont give a sh!t and here's the money... but it was pitch black on country road ... let me know what you think

Oh well, ticket is ticket.
Wait till you get your court date and because you have a clean record, you are more likely to get PB&J (Probation Before Judgment)
Basically, you do not get any points, however, if you get caught next time within 2 years of your probation, then they start with all the other goodies...
Anyhow, wait for your mail that notifies you of your court date.
on day of, dress appropriately and plead guilty.
Some plead guilty with explanation (but not necessary, in your case, you can say that you are not familiar with the road or w.e, but it doesn't really matter)
Your fine is more than likely going to be lowered.
After you pay the fine, you good to go!

do you guys have mr.ticket in texas? We do here in Cali - basically it cost 100 bucks and he gets the ticket dismissed for you

I love fighting tickets. I get almost all of them dismissed before trial and the rest I am always found not guilty.

First, go measure the speed limit signs. What is the exact ordinance number? Request the engineering study done by the county or state traffic and highway departments (depending on who owns the road).

After that, you'll want to write a discovery letter and request documents including radar certifications from the officer and calibrations done on the actual unit (assuming it was a radar ticket and not laser or pacing).

After all that, hopefully you'll have something to work with and you'll make your motion to dismiss. If you have something solid, the case will be over, if not, the prosecutor will realize you are just going to cost them money by going to a trial and will make a deal.

Can you really do this? I got hit by a radar last month and my court date is coming up, I can use all the help I can get! Where do you even start getting any of this information?

So you were speeding? Regardless of how dark the road was, it is your responsibility to take note of the posted speed. I am sure you can some how get out of it but you did the crime. Take traffic school to get the points off and pay the fine. Good luck

Yes. You just send the request to the prosecutor with proof of delivery and I normally email it to the chief and court clerk too (if a small department) because they will generally have to help the PA get the documents together.

I can send you an example of my last discovery letter for a speeding ticket if you want.

Also, is your court date an arraignment (where you just plead guilty or not guilty) or is it the trial?
