Bad situation

Angry Bad situation

I sold a car in Houston Texas a year ago. The person who bought the car never registered it in the state of Wisconsin where he resided. He never got the title in his name. So it's been a year now and two weeks ago we get a call from impound in Milwaukee saying if we dont come pick the car up within the next day they will send the car to auction and we would be out of pocket all of the fines because we are still liable for this vehicle. So we flew down to Milwaukee got the vehicle and sold it again. We hadn't heard from the kid before we sold it and now after the fact of selling the car he calls me and reports the car stolen and went to the place where we sold the car and they placed a hold on the check that they gave us for the car being sold to them in Portland Oregon. This guy never got the vehcle registered in his name. All he has is a invalid title and thats it. Who is in the wrong? I have to get an attorney but want to see what I'm getting myself into.

I know the grammar is pretty bad but its kinda late and im too stressed to bother.

Usually a bill of sale and transfer of title leaves you out of the mix. So how did that not happen?

It was a cash deal he gave me the money I handed him the keys & he said he would take care of all the paperwork.

In Texas there is an app for certificate of title, you fill it out and give it to the buyer. Was that done?

You filled out the Certificate of Title App right? See whenever I do these things I make copies of it all, especially if I need to rely on the other party to get things done. That way it's CYA.

ALWAYS make and sign some sorta contract. Whether being transfer of titles, bill of sale or pink slip signed by both of you even for cash deals.

Keeps you from getting sued.

This might get ugly for you

Wouldn't the buy have to get some kind of paperwork to get temp. plates or something. Which in turn would show that he is the new owner?

You didn't even sign a basic Bill of Sale saying you sold the car and he bought it? Yikes...

Exactly. I would chalk this up (once you are done paying lawyer fees etc.) as a life lesson.

Missed this post. WTF? Looks almost word for word like the OP's post. Do we need to move this to Ramblings?

A number of things don't add up as noted in the E90 thread. Why would someone fly out to get a car that they sold and was impounded, then sell it again?

Worst part is, this guy isn't even original and just wants a response. So lets close this thread and ban this guy and not give him what he wants. Some people are just too easy to make fun of so the best thing to do is ignore them.
