Hey so my tl can be started without having to have the brakes pressed.
If the starter can be energized without you pushing the brake pedal, that means the switch on the pedal is most likely stuck "on". I can't remember how many switches are actually on the brake pedal. For some reason, I think there are 3 on the manuals and 2 on the autos? I do not know which switch controls the start safety stuff.
Can you shift out of Park without touching the brake pedal?
Do your brake lights work?

Based on this thread, you don't need to press the brake pedal in order to start the car:

Many (most, all?) newer cars with push-button ignitions require it. On such cars, pressing the Start button while not pressing the brake pedal allows you to get to the Accessory and On "states" without starting the engine.

Hmmm....good point. I had a MT, so it was always two feet to the floor before starting. I don't recall ever trying to start without pressing the brake pedal...I know the clutch had to be pressed. Things you just don't pay attention do, just let muscle memory take control and drive.

It's been 4 years since my TL ws sold.
I still every once in a while catch myself putting two feet to the floor to start my current car. Earlier this year, I jolted my kids by catching the brake pedal with my left foot as I approached a stop light. For some reason muscle memory took over again and my left foot clipped the edge of the brake pedal. Scared the crap out of my kids, surprised me for sure....then I just started laughing....and then realized...I miss my TL.
