Got hit

Got my TL ass kissed by a spanking new Inifiniti FX45 this morning TWICE in fast sequence - boom, boom !
This happened in bumper-2-bumper traffic @ about < 5 mph.
the guy claims the FX45 didn't responde to his hitting the brake.

The only visible damage is light scratch on the rear bumper by his front plate. Color of the plate was like rubbed in. Bumper is stll aligned in place.

question:
Never got hit b4.
Should I bring the car in to a mechanic or dealer to have a look
at ? Maybe something I don't see ?
What is the max force (mph-wise) the bumper can take ? Does the MASS of the car matter in how bad damage is ?
What is the minimum impact (mph-wise) one can "shrug-off", if any ?

Better safe than sorry. Hope you got his insurance information. take it to a body shop and let them estimate.

Yes, I got his insurance info, also 2 witnesses info (they both volunteered saying the FX45 was driving like an asshole)

I didn't call the cop though - was that stupid of me ?

you don't need a cop...didn't sound like the accident was too serious. last time i called the cop, he asked if anyone was hurt, i said no and he's like you don't need me.

anyways, i would take it to the body shop and have them look at it.

If you are sure the speed in which you had been hit was less than 5 miles per hour you should be okay. But get it checked.

The max force a TL can take is 5 m/h or 8 km/h.

As you had been hit with a SUV, you may have received additional damage.
With the Acura TL it's a crap shoot, I wouldn't worry for anything under 5miles, but still would get it checked out.

I don't agree, usually the insurance company's always want to see a police report. In most cases they may ask you to go get on after you make the claim. G'Luck.

Despite what livinforyou posted (and the information was somewhat accurate), you ALWAYS call the police when you get into an accident. I've stated this a couple of times now (and the mods really should put up a sticky for this kind of thing since people really don't know what the heck to do in these situations) but here we go:

Even if no one is injured and both cars are drivable, you should call the police. The police will take down the information and statements of any witnesses (hey, sometimes they forget, or cannot be found later), verify the insurance information and driver's license info for all parties involved (you'd be amazed how many people are driving on suspended licenses and the like... the cop will know and take appropriate action, on your own you're screwed), AND most importantly, the police officer will keep a record of the incident in his own files. This last part is especially important when the insurance companies get involved...

From personal experience, I can tell you that calling a cop, even for a minor fender-bender can save you a lot of trouble down the road when you try to get your vehicle repaired.

So yeah, always call the police, regardless of the severity of the accident.

Indeed. No matter how minor, always call the police when in an accident. It is a good thing you have witnesses.

Bring your car in and have it checked thoroughly. Some would say no big deal....poppycock. You pay good money for your car....you deserve it to be tip-top.

Definitely take it in if you can't inspect it yourself. Though there may not be any superficial damage, you don't know what's going on behind the scenes.

perhaps a dumb Q.. (but) when u call for cops.. you don't dial 911 ..do you ?
do u just call the local PD office ? 'cause I would imagine that if the accident is "very" minor, like in this case(under 5mph).. it would simply be a waste of resources to get a police officer coming down just for that.. Also .. I don't think that insurance requires police report.. especially if there are witness with same stories..

I may also be wrong, but I also heard somewhere that police do not want to be called unless there is a certain amount of visable/financial damage to the vehicle.. is that correct?

Should call the policia...

Definitely call the cops, even for a minor one.

In this case the cop would probably write a ticket because the FX rear ended you - twice - for failure to be in control of the vehicle. In my state if someone rear ends you it's automatically their fault for following too close.

The other guy getting the cite might help you avoid getting a insurance rate bump if the damage is more than superficial. If the paint is scratched that could run into the hundreds to get fixed.

Got assessment at body shop
rear spoiler comes off, Bumper comes off to be repainted = 6.7 Hr labor, bill comes to $505

saw a 2005 RL wrecked on the right side.
Told the driver had some sorts seizure and smashed into guard rail. 10k job.

I respectfully disagree with mio .. Assuming everything is above boards and everyone agrees, you MAY not need a cop. However, if the other driver changes his story, if the witnesses disagree, if the other insurance agency fights it, if Mercury is in retrograde or any other damn thing comes off as just a bit out of whack, a Police report will become crucial.

Do the cops want to respond .. probably not, do they need to respond, yes. Like it or not, the other driver broke the law by causing damage or injury to his or another's person or property.

Hopefully all will go well with the claim. Let us know .. for anyone else .. call the police from the scene!!

Uh... if the driver is driving on an expired/suspended/revoked license or the tags are bad you'll have a hell of a time getting them to pay. This is why we call the police.

Surprisingly, the courts like to offer the benefit of the doubt to people who break such laws, leaving the driver (i.e.; you) holding the check.

For the aggrivation and possible expense that you can save, just suck it up, follow the directions in the nice little pamphlet that they gave you when you got your insurance, and call the police (and yes, 911 is the number to call... they'll report the traffic accident as such, let the cops know that no one is injured, and go from there).

Come on guys... haven't any of you ever been the victim of a driver lying their way out of an accident? I've been in the spot and was thankful that I am anal enough to have gotten the police involved. It was the cop's personal notes that put the matter to rest.

well, i think the bumper for the tl is purdy good; i read on the forum that somebody got hit by a mack truck and sustained only paint damage.....but glad no one was hurt.... g' luck!!!

Calling the cops is one thing, getting them to come out is something else; depends on your area.

In my city, for fender benders, cops say 'no blood - no cop on scene'. You can go to local station to file a report. I would make the call however.

I would call the cops too, 911 (don't know the local number) since they would probably be able to advise the police best and everything, but I have a question.

Should you move the cars? Like in this situation, it would be good to move off to the side of the road I would think, but will that influence the report? I'm pretty sure it wouldn't with something little like this, but if it is something more major, should you leave the cars as is, so the officer can document that they hit you, and you slid into a pole or something? That way they can verify the damage is from them hitting you into the pole, and not you accidently sliding into one a month back?

You should call the police to see if they will check it out but depending on the area they will probably not show. I live in the DC metro area and they are too busy busting crack fiends...

So yeah, always call the police, regardless of the severity of the accident.
I agree, but you know what cops do Houston and Austin? If you call 311 to get a cop to come out, they will ask you if anyone is hurt and if you need an ambulance. If you do, they'll be there asap. If not, you sit around for 2 hours or more before they show up. You can always get all the pertinent info (take pics if you have a camera and get witness statements and contact info) and then go to the police station and file a report.

sadly it's not as big a deal to the insurance company unless an officer is at the scene.

If they don't arrive within 30 minutes, I'd just call them again... I had to do that on two occasions (nobody bug nobody give attitude like a Philly cop), and just mentioned to them that:

1) Apparently their officer cannot find the site of the accident... because despite being there right away, we've seen a couple pass by without stopping (which was true... never lie about that).

2) Since both vehicles are damaged and on the side of the road, there is a good chance of causing an even worse accident from gawkers...

Usually they get the message. Believe it or not, I had one tell me that it wasn't his "job" to do this when he started filling out the form. My dad said that it was the first and only time he ever saw an officer get dressed down in public by a civilian (I have ways of letting you know when you're being a moron, and I've dealt with these guys professionally enough to be able to do this without too many repercussions).

Despite what the police seem to think as of late, they still work for us... and are supposed to serve and protect the public. But around where I am, it seems that all the folks that we expected to see in jail either ended up there, or ended up at cops. Kinda gives truth to the old saying, eh?

I guess if calling the cops I can say something like "no blood here but my neck is hurtin' like focking hell!" maybe they will show up faster ?

If the vehicles can be moved, and are blocking traffic, you should move them to a safe area. Only move them as much as possible to ensure your safety. If you got pushed into a pole, I would leave the vehicles, as you don't know how much damage to you, your car, or the pole. Get yourself safely out of the way, call th epolice and let them know that the vehicles are blocking traffic and a utility pole (or whatever) was impacted. they'll respond pretty quick as that indicates potential for an even greater problem (electrocution, other vehicles, pedestrians, etc.)

MR1 - If the cops tell you they will not be responding, all the better, you have your recorded phone call if necessary and you don't have to wait on the side of the road until they show up.

Finally, hope all this is academic and no one else on this forum needs any of this info for their own use.

Brewmaster is right, but remember not to drive too far from the place that the accident occurred. It sounds like common sense, but people manage not to do it and for one reason or another, screw themselves over.

As for the cops saying that they won't come... again the master of the brew is right, but I still say to call again... a repeated refusal to come to an accident always looks better to a jury
