Joint Checking Account - Need HELP!!!
Alright, my buddy is getting screwed (not literally anymore) by his ex-fiance. She dumped him 4 days before the wedding and has been bringing her heroin attic "friend" over and sleeping with him. My friend and his ex just purchased a house together a month ago, so she's literally banging this dope head in the next room until she gets her own place.
So...she cost him alot of money and refuses to pay her half of the mortgage and bills. The dope fiend won't pay rent but he can't kick them out because her name is on the mortgage.
Last night the ex had her tax return deposited into their JOINT bank account and he transferred it to his personal account before she could get any of it. Is this illegal? She's threatening him, but does she have a case? It was deposited into a joint checking account.

This crazy girl doesn't have the money for a lawyer, she can't even pay her bills. Her family is on my friends side, so no help from them either. My friend said he would give her some of the money if he wrote her an email listing all the drugs she's doing and admitting she's sleeping with this loser. Not a bad thing to have if they do end up going to court down the road.
The money went into a joint account. He withdrew/transfered money from an account he has the legal right to access. I see no legal problem with that.
As for the drug addict, I'm wondering if one owner of the house could call the police about a trespasser if the other owner invited them in. Not sure. But he could call the cops and tell them there are two people doing drugs in your house.

My friends parents are going to refinance the house in their name so they will own it. The ex has agreed to do this so she won't be responsible for the mortgage payments and then she can go live in a crack house.
I'd be inviting all of my friends over and having them go into the other room as they pleased. Even remove the door from the room. She wants to play it the way she is, pull out all the stops.

The bad thing is that my friend is a super pansy and won't man up and do some of the stuff you recommended. He's playing by the book while she's not. I agree that he should do all those things but he won't, he's a wimp. I was surprised that he actually went through with transferring the money to his account. So...do we all think this is a legal action he's taken?
It's legal as far as the bank is concerned; it'll be a civil matter between your buddy and ex-fiance.
He should close the joint accounts, and your buddy will have to pay the house bills and mortgage until the house is refinanced if he doesn't want to take the credit hits.
This sounds pretty bleak for your buddy, other than the ex being willing to sign off on the paperwork. It sounds like your buddy may have to eventually evict the ex and her junkie BF.
