Thank god I am with Cingular. On Monday, I bought the new Treo 750. I will be returning it today and purchasing a LG CU500 to hold me over until June. The Treo 750 is nice, but there is nothing innovative about it. It is what I expected and nothing more and has been rather overwhelming so far. The iPhone will be a much better fit for me.

That can't be right... whats to stop someone from doing that every couple months and selling their old phone for a profit? I know on Sprint you have to wait 18 months from your initial agreement.

What is the possibility of Apple upgrading to 3G between now and June? Since that seems to be everyones major dissapointment.

It doesn't really say anything about that price only being available to "new customers", it just says "2-year contract required". But yes, I agree... there's quite a loop-hole there.

Right, but still Cingular is subsidizing the price of the phone in exchange for a two year contract. If you are 6 months into a two year contract, you still owe them another 18 months in exchange for that first phone.

This was the way I asked about it in Best Buy and they pretty much verified this. If I get a new phone at any point before my 2-years are up, the day the new phone is activated starts the 2 year countdown all over again. So if I buy a Blackjack now, and an Iphone in June/July, my 2 years resets when the Iphone is activated... so it the contract now goes through June/July 2009 instead of Jan. 2009...
I mean, what do they care? At this point they just retained me as a customer for 6 more months by default, all b/c I decided to change phones...

I just got off the phone with Cingular customer service. I signed a 24 month agreement on Oct 29, 2006. I am eligible for an upgrade August 29, 2008. I think Best Buy guy was yanking your chain.

Cisco (CSCO) has owned the trademark for "iPhone" since 2000, the result of its purchase of InfoGear, which owned the trademark previously. Since December, Cisco's wireless division, Linksys, has been shipping a family of cordless and wireless phones under the iPhone brand.
"We think Cisco's trademark lawsuit is silly," said Natalie Kerris, an Apple spokeswoman.
Several companies already use the name "iPhone" for Voice-over-Internet products, Kerris said.
"Apple is the first company to ever use the 'iPhone' name for a cell phone," she said. "We believe that Cisco's trademark registration is tenuous at best."
Kerris added: "If Cisco wants to challenge us on it, we are very confident we would prevail."
Late Wednesday, Cisco asked a U.S. district judge for Northern California to order Apple not to use the name for a device that it introduced on Tuesday during an annual trade show.
Apple intends to begin selling its iPhone sometime in June, which provides a five-month cushion for both sides to reach some kind of settlement. Should that not happen, the suit could impact sales of the device.
The lawsuit follows years of negotiations between the two companies, which continued even as Apple (AAPL) Chief Executive Steve Jobs was introducing the iPhone Tuesday during the Macworld show in San Francisco.
Cisco took the iPhone's introduction as a sign that Apple had agreed to Cisco's terms for use of the trademark. In a statement issued Tuesday, Cisco said that it suspected Apple had agreed to terms, and was expecting to hear from the company later that day.
But the paperwork never arrived, a Cisco spokesman said Wednesday.
"Cisco entered into negotiations with Apple in good faith after Apple repeatedly asked permission to use Cisco's iPhone name," Mark Chandler, Cisco's senior vice president and general counsel, said in a statement. "There is no doubt that Apple's new phone is very exciting, but they should not be using our trademark without permission."

Like I said, I've done this with Verizon a couple of times and never had a problem. Verizon has a "new every two" promotion which they've had for some time now. Basically, every two years you're eligible for an upgrade and when you buy a new phone, you get a $100 rebate on top of whatever incentives the phone has already. When I upgraded my Verizon phones 6 months into the contract, all that happened was the 2 years started over again, and I did NOT get that rebate... but I still was able to buy the phone at whatever the 2 year price was on the shelf. One of the times it was a cheap phone, so it was free if you did a 2 year agreement, so even though I wasn't eligible for an upgrade b/c it had been less then a year, I got that phone for free, and stated my 2 year contract all over again.
According to Best Buy, same applies for Cingular. Now, whether BB handles things differently then a Cingular store or Kiosk... I don't know, but the BB I went to would allow me to get a new phone whenever I wanted to, but the contract would start over again at the time of the new phone activation. The only problem is that BB does not carry Smartphones... so before I did anything I would check with a local Cingular store/kiosk and get it in writing from the manager...
