Here is my situation. i just purchased a 2005 tl with navi with 76,000 miles on it about 12 days ago. A week after purchasing it, I started hearing a sound, like a blown gasket coming from the engine bay. The dealer i purchased the vehicle from will not fix it and claims they are not responsible, and i only have a 60 day warranty on engine and tranny. I took the vehicle to the acura dealer and they showed me that the vehicle had been in a prior accident (one not reported on the carfax) and the subframe was spot welded together and the axle boot had come off. Anyway, does this put me under the lemon law or anything? Can the dealer get away with this. Likewise, I had Acura fix the axle and one of the lower gaskets, however the sound is still there. They say I may have a cracked cat or i assume the gasket from above is blown. Is there a way to see or test to know which it is? It get really hot up there and you can't see it from the bottom or top and the fan keeps blowing hot air, so its hard to tell.
Depends on what your contract and warranty cover. Also, your state consumer laws regarding used vehicle purchases.
Keep receipts, read fast and act accordingly. Lesson, don't fall for a pretty face or believe dealers and salespeople. The car should have been checked by an independent mechanic prior to purchase at your expense. Carfax is not perfect, just a starting point. Good luck, hope it works out.

The written warranty shall require the dealer or his agent to repair or, at the election of the dealer, reimburse the consumer for the reasonable cost of repairing the failure of a covered part. Covered parts shall at least include the following items:
(a) Engine. All lubricated parts, water pump, fuel pump, manifolds, engine block, cylinder head, rotary engine housings and flywheel.
(b) Transmission. The transmission case, internal parts, and the torque converter.
(c) Drive axle. Front and rear drive axle housings and internal parts, axle shafts, propeller shafts and universal joints.
(d) Brakes. Master cylinder, vacuum assist booster, wheel cylinders, hydraulic lines and fittings and disc brake calipers.
(e) Radiator.
(f) Steering. The steering gear housing and all internal parts, power steering pump, valve body, piston and rack.
(g) Alternator, generator, starter, ignition system excluding the battery.
He never gave me a written warranty and I already had to change a passenger side axle and my car is still in the shop getting this exhaust leak fixed (which may be a cracked pre-cat or gasket).
Therefore, is there a way i can be reimbursed for these charges. To my understanding, a car cannot pass inspection with a bad axle and an exhaust leak. I was sold the vehicle like this.

You can see the rear cat from under the car, but if the subframe was damaged to the point that it was welded, poorly at that, then there is probably a lot more wrong than just a leaking cat.
Is there anything about a grace period? I would take it back. Sounds like they sold you a piece of garbage.

If you can argue that the dealer from whom you purchased the vehicle knew or should have known about the subframe issue, you may have a legal case.
If the Acura dealer was able to easily ascertain (either from records or visual inspection) that there was subframe damage, you may be able to argue that the dealer from whom you purchased the car should have known that also, and should have disclosed it.
I'd suggest you talk to an attorney about it.

Did this car have to pass a state inspection before the sale? If the car won't pass inspection now the it would pass inspection then. Somebody's liable here. Time to check the lemon law and get a lawyer ready. I can't believe this dealer did not know about this damage. If they did it sounds like fraud. What dealer is this?
I know it can get expensive, but this is definitely a legal matter at this point. You should also put the name of the dealer up in this thread to blacklist his ass! Also, report this to your State's Attorney, BBB, and if possible, local media. Let them know you intend to do this as well! Good luck!
