What Defects on the TL would fall under the Lemon Law

There are no specific defects for the lemon law. The statute varies from state to state but they usually refer to "major" and "recurrent" mechanical malfunctions that are not addressed "satisfactorily". As in most laws it is ambigious enough so that its up to the reviewing judge to decide. Squeaks, rattles and vibrations that only the driver notices need not apply.

Not true....I have a friend who had his Ford replaced under the lemon law for squeaks and rattles. It was horrible, and the dealer couldn't fix any of them. It turned out that several weld's in the body were faulty, and the whole car was basically a POS. He was persistant, and got a new car from Ford.

Was this Ford really taken back under the Lemon Law or was it just taken back by Ford? Lots of people that think their buyback or replacement was under the Lemon Law would be surprised to find out it wasn't. Manufacturers would often rather do it on thier own, even if it would qualify under the LL, because they can resell it "untainted" that way. LL cars in some states are so noted on the title.

In this Ford's case, with defective welds, I could see it qualifying under LL. Those aren't normal squeaks and rattles. But if your Acura TL glove compartent rattles, you aren't going to get a new car. If that were possible, every single car ever made could be made to qualify for Lemon Law replacement. If there's some fit and finish issue you don't like, and better parts aren't made, get a new car. Don't like washing the haze off your windshield in the summer? Get a new car. Tires wear a little funny?....

hybrid..I see your point about people constantly bit##ing about every little problem. I'm not sure about my friends car, but now I'm curious and next time I see him, I'm going to ask him more questions about the incident.

Funny you mention that....my boss had his last gen Audi A8 taken back by the dealer because it was a lemon. He got the brand new A8 and was happy. Did his old car go to the junkyard or back to Audi corporate??? Hell no, two weeks later I went in there shopping for an A4 and there it was, on the Audi dealer lot with a fatty "As Is, No Warranty" sticker on it. Scary, huh?

Lemon Laws differ from state to state. My advice is to take an hour or so and do your research. By googling, you should find numerous sites at your disposal to make a determination. If doubt is still there, then talk to your parents as they would more than likely know someone in the law field who would help.

I think the 1500rpm vibration would fall under the lemon law, as it will detract from the value of the car. If I were to test drive a used 2004 TL and found this noise and vibration, I would question the transmission or engine and would try to negotiate down the price, or even reject it completely due to fear of the car having major problems down the road, especially since the 2nd gen TL had tranny problems, as did the odyssey and CL's

My 2 cents

I think that those that have this problem, and who try to trade it in to a non-Acura dealer or sell it on their own will have difficulties
