Speeding Ticket?
Speeding Ticket?
Coming from visiting my girlfriend in Charlotte, I got a ticket. He clocked me at 79/60. Here is the deal. As I went under a bridge he was on the right side next to the bridge. My detector went off before the bridge and I slammed on the brakes. When I got to him I had slowed down a little. I told him I thought the speed limit was 65 and he said it was before the bridge but it is 60 after the bridge. I was so pissed that I did not go back to see where the 60 sign was. I will get my gf to look next time. Can he get me for speeding in a 60 if I was not there yet? How much room do I get past the sign to slow down? I was still speeding, but I would like to fight it. Any suggestions. On the ticket he Honda instead of Acura. Can I use that against them? This was in South Carolina by a State Trooper. Anyone know SC law about how fast you have to be going for it to go on your insurance?

Exactly what I was thinking!
If he can't read ACURA on the back of my car or on the registration right in front of him, then how is he sure he clocked me on such a busy interstate? Maybe have a chance with that.

As long as he's got ur drlic# and plate# number right he could've written toyota 3.2TL for all it matters. So as far as getting the make wrong that wont fly. But u should try to argue the whole 60-65mph thing.
Incorrect information as described here will not get a speeding ticket dismissed: http://www.motorists.com/issues/tickets/ticketFAQ.html
I got a parking ticket once where they got the car info right (plate#, VIN, make, model, color, etc.), but they had the wrong street!
I was in college at the time and the court house was near school, so I figured I'd go to court.
When I went up there, the judge thought I was some cocky kid and was waiting to hear my excuse for trying to get out of the parking ticket, which was for parking too close to a bus stop.
When I told the judge that I was not parked on that street and that street does not have a bus stop. The judge looks over to the cop and asks "is this true?". The cop looks at it, scratches his head and says, "yep, he's right. The ticket is wrong".
Judge then looks at me and says, "this must be your lucky day?". I respond. "Yes sir!".
Case dismissed.
Moral of the story, go to court and give it a shot.

In SC it was 2 points off your license if you were 5 - 10 mph over the speed limit.
4 points if you were 10 - 20 mph over.
20 mph over is reckless driving and 6 points off.
In SC you had better get a lawyer if you want to fight a State Trooper. The judge will have eyes and ears only for him.

I had practically the same situation. 80 in a 60 mph zone. There were no speed posted from where I enter the freeway to where I got the ticket, but I still could not get the ticket off. I hired one of those mofo ticket lawyers even and they say it was no way out. So right now I paid 150 for the damn lawyer, who says they can 99.9% of the time get the ticket off on some technicality, but I guess I must have been the .01%.
So right now...I am taking "defered adjudication". Which is i have to pay additional 150 plus taking defensive driving and 6 month probation. When I complete this, I will get 25 bucks back and the ticket will not be on the record. But if I get in trouble within my 6 month probation...then I'm in deep shiet!
OK...hope you feel better after hearing my story heheh.

That's the way Americans think: go to court even if you are dead wrong, see if you can win anyway. Nobody takes responsibility, even when the penalities are relatively harmless or small. That's why the courts are so full. Everybody sues. That's ok. I used to do that too when I was younger, found myself in traffic court every year, about a dozen times (so I'm not blaming anyone here, do what you have to do). My avg is about 9 wins in 12 appearances a long time ago. Later in life I learned to take responsibility and just pay the price if I was indeed guilty.
However, if you would like to fight it, I think you either need a lawyer or you need some legal basis for your defense. I don't think there is any leeway in the sign postings except if they were unreasonably located or unreadable. Perhaps there are speed trap laws in SC that made this stop invalid?

What I have a problem with are cops who are picking off people for speeding on highways where the limit (admittedly IMO) is artificially low. Especially speed traps that are set up solely for generating revenue.
The motto of most police departments is "To Serve and Protect".
Maybe it should be changed to "To serve and collect".
