Motherf'er- (Pics)

im driving along to go get my front sway bar finall installed, since i stripped the endlink hex part... even planned to do a full detail to my car after i was done with that... moderate traffic... 20-30 feet away from the exit. and boom

















WHY ME?!??!?!?!?!!?
ive had 3 cars so far in my 1-2 years of driving and i got in an accident in each...

driver says he looked away for one second.

someone up above hates me.

does anyone know if i will need a new trunk lid? is it misaligned or anything...
looks like i need a new bumper and tailight, any input?

seems to me that you need a new rear bumper cover, new deck lid, right tail light, and possibly a new rear bumper reinforcement. The damage seems severe but not to the point where the frame appears to have been compromised.

i agree, but maybe not a new reinforcement. it's at the corner, probably just scraped -touched the reinforcement

i think it maybe worse than what you think. something similar happened to me, offset rear ending, and it only left a light scratch and indentation of the characters from the license plate frame. well, it turned out that the trunk structure by the spare and the frame area that the bumper bar slips into had been bent and needed straightening! definitely get it checked out properly.

That is right. The bumper absorbers are probably crushed. those have to be replaced. Not only where the impact gets damaged, check other places as well, such as engine mounts can get damaged too depending on the impact. Have it all check out and request only OEM parts.

got back from the shop.
turns out the asshole insurance policy was cancelled.
shop is estimating it over 2500.
cant afford this shit, policy is under my name-19 y/o

the only thing that will make me smile a bit is now i can finally go Mugen.

yes as a matter of fact it could have been much worse.
my dad is in the hospital now (for over 5 months) due to a car accident.

Last October on Hywy 680 in the SF Bay Area, the traffic stopped, I stopped but the two trucks and Camry behind me didn't. Offset hit like yours only worse to the tune of $8K (new bumber, trunk, right quarter panel and supporting structure).

The car got fixed and looks and runs great. Unfortunately, my neck and back are still giving me problems. Physical therapy, occasional Vicodin and Flexiril have helped but I still have bad days.

Consider yourself lucky. Cars can get fixed or replaced. Your body can be a different story.

yeah i am, its just a sudden shock at first about my car, especially when i was going to go do something to it... and my dad bought it for me as well.
i hear you on taht though... my dads in the hospital since June 23rd after i dont really know what happened, but someone slammed into his passenger side and he's in a Tramautic Brain injury rehab hospital right now...

can anyone tell me what i can do?
turns out the car the driver was driving- the insurance policy had been cancelled...
so i dont know what steps i can do now.. or am i just out of luck.
can i sue?

Your insurance policy may have "Uninsured Motorist" coverage. Even though you are not at fault, using it may or may not have an impact upon your rates.

yea if the person who hits you doesn't cover damages out of pocket, sue them. you have every right. if cops came they would have gotten their license suspended for no insurance.

NY is a mandatory insurance state. Everyone that drives a car in NY, no matter the age of the car is required to have insurance at all times. You can file a claim with your insurance company and give them his insurance information. From there your insurance co. will contact his and find out he has no insurance and the subrogate against him to collect what is due them. Your car will get fixed! That jackass will lose his lisence and be in collections very soon. I am a Collections Manager and used to do subrogation work your car will get fixed!

the Ford Windstar he hit me with isnt registered under him, its under a woman who i am assuming is his boss or something...
i got his license, registration and insurance... the car has/had Geico insurance
i went to my shop afterwards which my mom is coll with the owner, i called Geico and made a claim, they later told me their insurance company is under investigation or something, and they are not sure if they will be able to get her account. i got a call before from geico again and they verified the account was cancelled in Octobr due to a non-payment. i asked them what i can do and they said they may or may not go after the person themselves. depending if they feel like it?
i dont know, now i have his FRIENDS and UNCLE calling my house, claiming he will get arrested or some shit, and that they are willing to pay a thousand... which clearly isnt going to cover it... tthey keep saying that its just the bumper, and if you push the bumper down eveyrthing will be okay. and they want me to bring it to their shop or some shit, which i def. do not trust....
damn shady characters... i dont know what to do... im afraid they might do something as well. i had Omar, Hector and Jose call me all today.. LOL

Take the car to a body shop of some sort, one that you trust of course. Have them do an estimate. Call these guys back telling them the price. Also tell them that you will send them the estimate so that they can review it. Another thing to tell them is that he is to pay for all the damage or you will sue for that amount if not more. Make sure that all parts that are on the estimate are all dealer prices because as we all know dealer prices are a lot higher then aftermarket. (And they will fit unlike most aftermarket) Another thing, have you shop look for parts out if a salvage yeard. May be hard to find, but there usually are totaled cars there.

I must say though be happy that you were hit in the back and not the front. 80% or so of all cars in the yards are demolished front end collisions and most times, the rear is still intact.

Glad to hear that you are OK though.

His Friend's and Uncle are calling you? I might be missing something here but I am assuming this is just some random moron on the road that you don't know.

As a responce to those idiots calling you crying about getting arrested. This would have been my responce. They caused the accident, they didn't have insurance at the time. That's not your problem. You should have called the cops and had their car seized and his ass arrested. See if that is still an option. It would be best if you also had witnesses.

On your insurance end, do you have comprehensive coverage? This usually has uninsured motorist insurance. So if an a-hole without insurance hits you at worse you would pay the deductible.

I say go after his ass. Take the money first AND report his ass. Don't even bother to use your own insurance or pay ANY deductible. Why? Because I've been through similar shit. Guy hit and ran. I hate ghetto ass people who drives without insurance. Either get insured or stay off the roads period.

funny thing is.... i went to the supermarket last night.... guess who i bump into... driving the same damn van w/o insurance still!
and yeah. i dont know the guys... but the ycalled my house like 3-5 times yesterday, saying tey are willing to pay, but they think its just hte bumper!
i dont know what to do, i guess i will leave it up to my mom for now since i dont know all thats going on... i just want my damn car fixed, i dont care who pays for it...

if you have full coverage and uninsured motorist coverage, you would only pay your collision deductible and have your insurance company pay for the repair. this should not go against you...just one of those things and why you buy UM coverage! i guess if they are uncooperative, you can sue them in small claims court.

Talk to your ins agent and get some tips. Next time CALL THE POLICE and get a REPORT! ...lesson learned. See if you can still report the accident, your agent should know all of this and help you out, if not get a new agent.

Also take plenty of pics and see what the insurance will do, and you do get screwed by the ins companies ... if it's your fault or not, I am talking from experience.

Also don't forget about small claims court to recover what your ins co doesn't pay, even the deductable can be recovered ... loaners, etc.

I would not talk to any of his friends - talk to HIM, why isn't he call you?!?

Sorry about your wheels dude, what a bummer. Oh and did I tell you to always get a POLICE REPORT?!? :-)

the police said i have 10 days to report it or something...
the agent basically said their insurance policy was cancelled in October, so most likely im out of luck through insurance...
this stupid kid says hew ants to paint my bumper in his GARAGE *literally, his house garage.. LOL

im thinking i will go through my policy, pay my $1000 deductible, get everything done (i have full coverage and tehy said it will go through my collision) and take the registered owner of the vehicle to small claims?
should i just take em for the deductibble or something on top of that?
does anyone know what the chances are of my premium going up? they said its a no-fault accident and i have 0% negligence or something, and that im in the Highest party (Geico's) which i guess is a good thing cause supposedly its their "best" drivers.
i have no idea really on what to do, since im all new at this.

also, geico said newyork doesnt have Uninsured motorist PROPERTY coverage... only BODILY..
so i dont know how everything works.

k, well if your insurance is successful in pursuing these idiots in small claims court. You could get back your deductible if the court ruled they pay Geico the full amount of the repairs.

As for your premium going up because of this claim. NY and CA I believe are similar in laws that it stated, if the accident wasn't your fault your premium can't go up. Here is the kicker though. Your claims even if it wasn't your fault are counted against you if you ever switch insurance companies. The new company will see all your claims and if you had even 1 accident and it wasn't your fault, that could drive your premium a little higher at the new insurance company.

i think when i spoke to Geico he said I, myself, would have to go after them in small claims... Geico said they may or may not go after them themselves?
if i bring them to small claims myself, what are my chances? what will i have to present and defend myself? how much does small claims cost?

as far as the premium, so i should be good if i dont switch my ins. company? im already paying 19xx every 6 months... cant afford more then that

If your Insurance Company doesn't pursue them there is no chance of getting your deductible back. Small claims court is usual up to $3k. So you could pursue them for the full amount or your deductible. Other than that I don't know the process of small claims court or your chances.

Your premium should be unaffected by this accident. Just make sure at your next statement or ask your agent.
