Small claims is Judge Judy dude!! LOL ... no, it's not bad at all and if you have all of your proof there a piece of cake! People will settle out of court if they know that they don't stand a chance. First you can usually only win the amount that you had to pay, in this case your deductible.



I would try to get it from the guy first by writing him a letter informing him of the court situation if he does not pay up ... oh yeah, I would call the copsASAP and file the report!



Then if he does not pay file a claim with the local Justice of the Peace ... it's like $25 and get a court date. Here a judge will hear your argument and the defendant's, after which he will give his judgment in favor or against.



All of my cases (5) have been dropped/settled before this ever happened, because the other party (even 2 police cases) knew that it was their mistake.



The main point to remember is that you have to have all of the evidence in order and ready to go. Have ALL of your proof!

hmm, as far as insurance... my shop is making me only pay $500 deductible (my original is 1000) and might even lower it more... the guy who hit me is a real jerk, i hope Geico sues the shit outa em.

as far as my car, got a couple free goodies ... still not done, should be done around mon-weds.. going in for paint now...hes gonna get rid of all my oraange peel and make it clear

Honestly, just get it fixed and file it with the insurance comapny. It's the responsibility of the insurance company to handle everything - that's why they screw us with high rates. No need for you to bother with a lawsuit because they should handle their shit. Oh and make sure to check if the rear-quarter panel isn't damaged. Stand low at an angle and check if the reflection is perfect.

With that said, start looking on the bright side. You can have them fill the holes in the new trunklid and get a superclean shaved look.

that sux supreme dude. i just got my 2003 TL-S yesterday, and it almost made me cry thinking what would happen if someone hit me. i'm hating it for you man! take the insurance for all that it's worth! get quotes from at least three places before you fix it.
