charged for street racing anyone?

Question charged for street racing anyone?

i need some advice on what to do i got my car impounded for 30 days because the cop thought i was street racing with my friend because we were driving side by side.. the speed limit was 60 km/h and we were doing 80km/h..


this is what really happened: i just got my new exhaust yesterday installed and my buddy wanted to hear it so he told me to give it some gas to show how it sounded and the cops were on the middle of the road on the grass doing radar check and they clocked my speed.


the cop was being a **** he told me he can give me a ticket for 400 dollars but he rather see me in court and get me a bigger fine for $2000


i have a court date next month and i have a lawyer... just wondering if this has happened to any body before and any advice on what to do and what happened in the end


please dont flame me i know i shouldnt have done that.

doesn't sound like you were "racing". i'm not familiar with BC's laws, but good luck.

in the cops view- 2 cars side by side, speeding, and one does a loud revving of engine---racing!
Pulls cars over and sees many mods for speed and looks- you must have lots of money heheheheheheh- needs to get extra money for local govt on tickets..

Here they call it reckless driving and exhibition of speed- $2500 for the reckless plus double fine and double points--another 500 for the 12mph over you were going on a city street
Also here in Ca, if you pass someone on the freeway onramp- you are racing!- whether the other person knows it or not- in the eyes of the law you should fall in line- anything else is YOU racing

Talk to your lawyer- they will have some lame story for the judge- thats what you pay for

and sorry can't help, all of my tickits were just for speeding (by myself/one car only) and such and not any racing, also i don't know your moose laws anyways

Damn that sucks bucks bro..how long have you had the ATLP on for?? It's only been few days right? I bet your prob pissed you can't enjoy that bad boy.

Anyways, I wish I could help you out but I've never had this happen to me. Pretty much all I can say is get a good lawyer and hopefully you can get those charges reduced. Maybe bring your buddy along with you to court to corroborate your story.

20 over isnt anything big. just say what u were cruising home or what not. didnt look at ur speed just driving with the traffic. i got off twice by saying that.
now, if im gonna speed and potentially get a ticket for it, might as well be going hella fast.

Haha, it was only 20kmph over the speed limit too so if you can get away with what I'm assuming is 20mph over, kdawg you should be fine too. Just tell them the truth. New exhaust, riding with a buddy, wanted to show it off a little and didn't realize your speed had gotten so high..might just work especially if you don't have many tickets on your record.

i just got the atlp's installed yesterday and i get my car impounded the same nite

my buddy got pulled over also his car got impounded too and we both have the same court date and time


but his car is under his parents name so he only got impounded for a day

but my cars under my name soo im the registered owner and stuff soo they took it away for 30 days

i have lots of tinted window and no front license plate tickets from my old car
and i got my license suspended but that was over 3 years ago and i had my learners drivers permit.. i got caught with a speeding little bit over the limit during a radar check and i got suspended for 3 months after couple days.

but i been clean since then

I got one not to long ago, I argued that I'm a student and need my car to get my education also I told them that I was already signed up for and intended on acing my defensive driving course, also argue your near spotless record

UPDATE: the constable changed my 30 day impound to a 48 hour impound so i can pick up my car tommorow :S weird

take any break you can get~

Maybe the Constable in charge saw 2 tickets with widely different punishment and had to apply the law more equally
Hopefully the cop got reamed for it and court will reduce it to speeding and 200
hope for the best!!

Bonus Ca rule- If you get a racing ticket it has a provision with the fine- cant be anywhere near street racing or street sideshow type event, or racing yourself--for several YEARS
and some months later you are even SEEN at a street race as a spectator--(they use undercover/impounded cars they keep) and a video camera getting license plates and faces--all very casually--then go back to the station and compare to master list...

a plate or 50 matches then its automatic impound for 30 days!!!,,and they dont tell you, they show up with a tow truck at 5 am sunday morning while you are passed out!

We have too many deaths every day from street racing,and often its an innocent person coming out of a parking lot that gets nailed, 4 kids in a civic die hitting a lightpole and the other car splits..with felony charges for all the deaths when they get caught plus charges for leaving the scene

I keep my speed on the racetrack where its safer and cheaper than any ticket

02_TL-S is right! Tell the truth and this will all blow over. Especially since you have a lawyer. Most people don't go to court to contest a ticket, but if you do, you usually can get something out of it. 60kmh in an 80kmh is roughly 40mph in a 50mph zone! Don't know how stringent your laws are, but here its 25mph over the limit to constitute reckless driving!

Ihad something similar happen to me. 10:30 @ night on my GSXR, A buddy and I were "speeding" and next thing you know...Blue light special. Cop was traveling opposite direction, so my buddy guns it and

we outrun "this" cop. Nothing but a straight road ahead (and i live about 5 miles away) we left this cop until you couldn't see his lights. I turn off, my buddy goes straight( he runs into the road block) and

gets arrested. 15 minutes later the cops are at my door reading me my rights

Now here is were my luck comes in...I knew two of the three cops there and they decided(with my denial of knowing

nothing of what they were talking about) that i was speeding(and that i knew nothing of them behind me) therefore i was charged with misdemeanor
speeding instead of felony fleeing, evading, careless and reckless, no tailights(wired to a seperate switch), and whatever else they wanted to bash me with.


...Try to argue that you were only speeding and NOT racing (or you thought you were going with traffic)

to the cops the OP has an obvious racing problem- not traffic flow
Canada as I understand has little leniency for breaking its traffic laws
12mph over is a serious issue--note they impounded both cars!!!

funny Ca story- We just had 3 bikers coming back from reno to SF area- normally a 3+ hour 150+ mile trip,,, downhill from 5000 feet thru the mountains leading to a long straight section~ where speeds accidentally pick up~

Cops will lights and sirens blaring followed the 3 at speeds in excess of 100 thru 5 counties with the bikes not acknowledging the officers behind them- 2 finally pull over for the multiple tickets and the 3rd goes for it- unaware of the helicopter over him- Went right to his own house and was surprised when a street full of cop cars was suddenly there for him

damn thats fucked up how your "friend" snitched on you. if i got caught i would have told the police i didnt know the guy riding next to me.

it doesn't pay to speed dude. im learning that myself. I just moved my court date to another court and they made my court date in may. so i highly doubt the cop that gave me my tickets will appear there

on another note, just be honest and tell the judge. worst the judge can say is something else but go along with it and come in with positive attitude that's always an good impression

the 2 riders didnt give up the 3rds name- the cops here have cameras in the car pointed forward for the chase scenes!, and it can also automatically run every plate they see, ck it for stolen or other issues like owner has suspended license etc. and store it--remember in The Blues Brothers... I bet these cops have SCMODS,,,, state county municipal OFFENDER database system

By the time they were cruising thru a 2nd hour at 100mph with 3 cop cars lights blazing,,,there was a helicopter involved- no getting away from that - and thats what tracked him home and reported final position to the cars

Note the chp chopper only goes 120~ but has a great camera system

what impressed me most was the distance at speed without fuel stop,
my basic vtwin 1100 gulps gas when you play with high rpm like that
must have been carrying 5-7 gallons, which is huge on a bike

chopper also can go high so it can see a longgggg..... distace, but also it can go as the crow flies so it does not have to go around courners and stuff

hope they dont pull your exhaust bro. my car was impounded 30 days some years back and cops were nice enough to stuff my possesions under the rear seats...after they tore the car apart and threw a bucket of chicken all over. my car was damaged there too =/


as for fighting it...whether or not its racing, its still an exhibition of speed and theyll get you for that, unless you guys have different laws.

That happened to me once, they pulled me over cuz they thought I was selling drugs and wanted to search my car, but i didnt let them without warrant. I was harassed for 20 mins, then they just left.

know someone else who did that too with making them have a warrent, but they did not want to wake a judge up or something , so they finished the stop and just left (it was like midnight or something)(no tickit)

lawyer should take care of it. just tell ur lawyer what happened and hell work something out with the state attorney. well, at least my lawyer did. money well spent. dropped 4 tickets and reduced one. couldnt be happier.

you said you hired a lawyer- so why dont you ask them about it?- in the usa the lawyer does the talking

but you want to dree to appear as a responsible person- not tshirt and jeans kid who goes racing around!

see if the court is `open`- should be- to visitors, on a day well before your hearing
go sit quietly in the back
You get to find out where the speed traps are!! because several people will all have been stopped in the same place, and you see how bigger cases like yours are dealt with

gotta love laywers, well if you have the money. they do all the talking and know all the ins and outs of the law, but nothing is guaranteed. usually if you have a good record it should help your cause and they will talk to the cop before the hearing a couple times.

proably will easily save that much just in insurance (especially being only 21),
and maybe see if he will doing like a sliding pay scale, the more he gets the charge downgraded or dropped, the more he gets paid (can't hurt)
