ATTN: What should I do now?

So today, I just made the biggest mistake of my life. Basically was heading to school and getting ready to make a left at a stoplight when suddenly a G35 pulls up very close to the back of my car. So I go wtf? Then the light turns green and I slowly take off normally. Then he decides that he wants to mess with me for some reason (and later tells me it was cause of my exhaust). So after the left turn onto a different street, I take the left lane and he takes the right. So I'm like wth? This guy wants to mess with me, then let's go. Little did we know there was a motorcyle cop camped out in one of those curves that we were approaching. The cop lasered us at 68mph and it was a 35mph zone. Next thing I know, I'm stuck behind a stupid tow truck on the right lane. As I look to my left side mirror to change to the left lane, I noticed a motorcyle cop with lights on , talks on the megaphone , and says "pull over". He tells me to give him his license quickly so he could chase down the G35 , who already took a turn onto the street of where the school was at. So basically, I gave him my license and he took off trying to find where the G35 went. Next thing you know, the G35 follows the cop back to where I got pulled over.

Officer explains to me that we were clocked doing 68-69-70mph on a 35mph zone. I basically told him straight out the truth cause he witnessed us so no point in being a dumbass and trying to cover shit up. So basically, he gets down my info and the G35's info and they call in the tow truck and says that the car will be impounded for 30 days. At this point.. I knew I was in for some serious shit.

Cited for "speed contest" [misdemeanor] - cvc 23109(a) and "speeding" - cvc 22350 [infraction].

Anybody have any ideas how I can fight this if I can? I totally regret this... I was being a complete dumbass. The guy in the G35 got the same citations as me. I'm due at court on 4/20/10.

Can someone clarify how long a misdemeanor is? I've heard some say 7 years and I heard others that says it lasts a lifetime. I also heard in my situation, that it could be lessened down to just an infraction but that's only if I decide to fight it, in my case is hard to.. cause the cop knows what we were doing.. If I'm gonna fight it.. I need a good attorney..

So yeah.. I'm basically screwed for the next half year or so.. big fines , possible license taken away , possible jail time , community service . etc. I shoulda just let him do his thing but I easily got tempted.

Any comments and suggestions would greatly be appreciated.

damn impounded for 30 days thats about 1800 bucks down the drain. FYI. Get some Pre-paid legal. usually about 25 bucks a month. but its worth it for situations like this where you don't have to hire a lawyer.

Damn man. I never fuck around with someone else on the street just to avoid an outcome like this...or an accident.

If you haven't already, start looking online for Law forums. They helped me out some time ago and I got good info. It's a great start and will lead you in the right direction.

Under the California Penal Code, a misdemeanor can carrying with it possible jail time of less than one year and/or a fine of up to $1 000 plus penalties and assessments. Although generally considered minor, a California misdemeanor should be taken seriously because, if convicted, it results in your having a criminal record.

Misdemeanor Facts:

* A misdemeanor will likely show up on a background check
* Being accused of a misdemeanor or convicted of one can have devastating effects in the life of the accused
* In some cases, a misdemeanor can be raised to the level of a felony

For misdemeanor charges, the range of California sentencing may include jail time, probation, fines, and/or community service.
If convicted, a misdemeanor will not go away. It stays on your record for life unless you get it expunged.

^ Some people have told me 7 years, life time, or you can get it expunged.. the 7 years is probably for another state cept for cali .. idk..

might want to ask to have this moved to Ramblings or Car Talk since there's more traffic there. And I believe we have a few lawyers in the house (Ramblings) too.

I've never had the temptation to race anyone who tries crap with me.... but damn I guess temptation gets the best of you sometimes.

Can't help you on this.... You risked your life, and possibly many innocent civilians, and the stupid G35 guy... for what? A stupid 6 second speeding stint with a stupid fucking G35 driver? One of my friends was KILLED by a street racer when he was walking... It really hits home when you've had a personal experience with this subject..

I'm guessing the only thing you can do is lawyer up... I don't know if talking to the prosecutor would do anything.This is one damn costly mistake.... hopefully you have learned from it... even if it's the hard way... Do you parents know about this? I hope they don't slaughter you... Let us know what happens.

Tim and I nearly got the same thing, we were both speeding down Baldwin Ave on our way to AU79 one day. Saw the cop too late but he didn't do anything. :whew:

Yeah .. course my parents know about it. The saddest part yet is that yesterday.. my sister got into a crash .. so it's definately alot of money here..

well said man.. i definately learned a lot here.. definately not worth the money and time and the permanent misdemeanor on my record.. totally not.. if i had the chance to go back.. i'd do it in an instant and i would've just let him go.

I'd suggest you get this moved to cartalk, or send a PM to Will Y. and ask him for a referral on lawyers. I'm pretty sure he can help you out too.
The only thing is you'll get flamed like crazy when this moves... but at least you admitted it was a stupid mistake... hopefully they can do without namecalling and insults because you already understand. I'll see if I can find any lawyer recommendations for you too.

Excuse my french, but you're fucked. Street racing in cali is already a serious issue, and now that you've been caught, you're gonna have to pay. Especially with this economy, damn, they're gonna rape your wallet. Good luck with everything.

its a must appear in court situation-
go sit in on a court day and learn what happens to others - there will be similar

in Ca once convicted of racing- if you are even seen spectating at a street race or sideshow in the next 2 years...the cops come tow your car away at 5 in the morning- impound! sorry

lawyer consults are often free- lawyer help $1500-5000 or more
Be glad it wasnt DUI too, school zone is already double points and double $$ fine, same as construction zones- ouch- reckless driving charges..bad news on insurance rates
Try to get the reckless removed..

We were all young and stupid, some learned to slow down on the street and take it to the race track earlier than others
250 bucks beats any ticket

been there done that.

1. ur lucky ur car isnt going to be compressed
2. speed contest misdemeanors are pretty much set in stone, so dont waste money fighting it. (especially when the cop has an afidavit)
3. 30 days impound with tax and towing will run around $1800 as mention. mine was about $1500
4. misdemeanor is permanent but after 3 years, youre insurance goes down. you get 3 points btw, and itll double your insurance til it clears.

live and learn...worst part is, you ruin half of your 4:20 day

thats got be subjective to the type of crime and state.

i've gotten a felony when i was 17-18 and i can assure you my record is squeaky clean

never got a misdemeanor, but i dont have to be a lawyer to know that a felony is way worse.

to this day, after 4-5 tickets and my Destruction of proptery felony.. i have the record of a new born baby.

its all about how you go through with handling it and what kind of crime you commit IMO.

keep us updated though.. i seriously doubt a street racing ticket will be on your record for life....

PS. check into something Called P.T.I. (pre-trial Intervention)

this is the process i took when going through my felony.

i didnt do any jail time or community service, and like mentioned above, its not on my record.

they gave me a balance to pay off over the course of 2 years.. $4,200 (basically double the cost of the damage i caused) and after the balance was paid off.. the crime was wiped clean.

i think when he was pulled over they explained what happened to the cop (truth)

When he got off his bike , he asked for my license and then asked why the two of us were side by side racing down the street. My guess is that he had his laser gun out and saw the flyby .. Then he came out of his hiding spot and chased us down ..

As far as where the thread ends up.. I don't really care. If I get flamed at , then that's what I deserve I guess. But I already know what I did wrong , I feel bad for it already , and I totally regret it. Too late now .. All I'm gonna focus on now is just finding a good lawyer .. Try to lessen my misdemeanor down by expungement .. But that's after one full year .. Gotta pay my fines .. The most hurtful .. Getting the car outta the lot .. I have a tough road ahead of me so the least I would want to hear is the same story over and over again .. "That was stupid on your part" , "You put others in danger" , etc. I need good advice, not flamers.

to be honest, I dont even act up anymore, thats why i support driving SUPER LOW AND SLOW, SPEEDING WILL GET U IN BIG TROUBLE AND POSSIBLY KILLED, plus with our wonderful trannys, I wouldnt even think twice anymore

but if my car was 6spd i would be haulin some serious ASS lmao

but bro u made your mistake, in life u live and u learn, shit happens. Your situation already happened, now you just gotta look forward and keep it movin
