Got a ticket for 20 over

Yikes. Got ticketed for going 65 in a 45 last night. It's gonna be expensive. At 20 over the limit, I'm a little worried about it being wreckless driving. Anybody know the definition of wreckless driving in Cali? On a side note, the police officer wrote on my ticket that I drive a Legend...

I got a ticket for 32 over in florida and that was not wreckless driving thankfully and you might have a chance of winning in court seeing how the cop wrote down that your car was a legend then you wont have to pay any money

I've had plenty of tix, but this is my first one in a long time. Considering how fast I usually drive, I guess I was due. I've never been caught going 20 over the speed limit. A big fine would cut into the car budget.

When I was in North Carolina, I got a ticket for going 34 over. Anything over 15 is considered wreckless driving so I had to hire a lawyer. Since it was my first ticket in over 3 years, the judge threw it out and never went on record.

20 over in Cali isn't considered wreckless driving so relax. Anything over 35 is though. My brother got caught speeding on I-80 doing 101 mph in a 65 mph. The cop wrote 99 so it was just under a wreckless driving infraction.

That's BS. If you know you were speeding then why would you contest it? If you said "sir, I was only doing 15 over, not 20" the judge will probably give you a heffier fine because YOU WERE STILL SPEEDING. The judges doesn't like when you waste their time so just plead guilty and pay the $120.

Thanks, Bro's. I tried to find what constitutes wreckless driving in the California Vehicle Code, but all I could find are the penalties for killing someone while driving wrecklessly.

I fought a radar ticket about 8 years ago and won because the cops didn't show up for the trial. I had to sit thru about 10 of the trials while we waited for them. Good thing thing for me they didn't show up b/c the judge sided with the cops every time. It was a slaughter.

that wasn't exactly good advice. I tried to fight my estimated 115mph+ ticket and say I was going 90. The judge basically thought I wa an idiot and took my licence away for a month. If i would have just payed the fine he said my licence would not have been provoked.

there is always however that lucky chance that the cop doesn't show and the ticket gets dropped

Yup! The judges side with the cops 99% of the time. Stupid shit like "I was trying to speed up so I can merge" won't cut it either. If you get caught speeding and have to go downtown, then it's probably a good thing to plead not quilty and take it to court. I heard a lot of cops don't want to spend their morning at a court house and they especially don't want to drive there because of traffic.

Actually, you both partially right. Here's what happend 8 years ago when I fought a ticket in Cali. The first hearing is nothing but a trial setting - they give you a trial date a couple of months in the future. Someone from the DA's office was there and they offered to cut the fine in half if I pled guilty. If all you want to do is reduce the fine, then you pay up and leave. If you still want to fight, they set a trial date. There was no DA at the trial, it was you vs. the judge and the cops. Like I said in my earlier message, if you let it get that far, you got slaughtered (if the cop showed up).

I think anything over 100 is wreckless, I got one for 20+ and didn't get a wreckless. However it may be. Not completely sure.

actually if you fight it, and aren't found not guilty the fine is more then it would be if you had just pleaded guilty.

Thanks Dennis, that's pretty damn interesting. Did you see the penalties for Speed Contests? The first offence can be imprisonment for 24 hours to 90 days and fine between $355 and $1,000!!! Holy shit. I'm glad I was speeding alone.

Not sure about CA, but in VA if you were driving a CL and the cop wrote down Legend that ticket will be dismissed in court.

You might want to look into that.

not true at all, that's a myth. Unless VA is different then every other state. I've always heard that if they mess up your plate etc it'll get dismissed, but this isn't true. Esp. if you sign it.

whats up sac cl . the tic shouldnt be to bad . but to tell you the truth i have never fought a tic i diddnt kno i could win . i have found that the best thing to do is to plead guilty with reason . that lets him know that you accept you f ed up but still give him a reason as to y you did it . and ive had all my fines cut in half if not dismised ...... by the way , where were you when you got poped ? and was it lasar or radar that he got you with ????

I was driving on Foothills Blvd over by the Auction about 7:00 pm. According to the ticket, he paced me. I wish he was using radar, b/c I've got a radar detector and it would have gone off.

I went 18 over in Tift County, GA...$340 ticket. I had to ask them to repeat it. Couldn't fucken believe it.

pacing is shit... go to court and the cop probably won't show up unless he is a dick. I had 3 speeding tickets back in new york luckily they were all thrown out since the cop never showed up.. I had to hire a lawyer on one of them but then the cop didn't show up either.

anyway your best bet is plead no guilt and then hope the cop doesn't show.

Had the same thing happen in Los angeles, ticket for no registration. Cop didn't even turn in the ticket.

for my last tic i took the school thing online and it took a while but i could get up and get a beer when ever i wanted and it was a lot better than sitting in some dumbasss class for 4 hours

I dont think so...that doesn't make sense if you were found guilty you would have to pay court cost and the fine for the ticket. If found not guilty then you shouldn't have to pay anything.

I think you read that wrong Mitchel. He said if you ARN'T found NOT guilty. Nice double negative i know. He meant if you are found guilty after pleading not guilty the fine will be bigger than just paying the fine. But if you are found not guilty then you don't have to pay anything.

I past this one small town going 90 on a 60 and it was only $130. I past that town hundreds of time and that the first time i ever heard of it.

Well, almost 2 months later the bill for my ticket finally arrived. I was pretty surprised that it was only $188. Woo hoo. I was expecting $300+. I could go to court and get it reduced, but that will be a major pain in the ass with my work schedule this month. I'm gonna pay it and get it over with. I don't have any other tickets on my record, so I don't think it will affect my insurance.

ACTUALLY, in Cali, doing 25 or over the speed limit is considered a misdemeanor. I'd go straight to jail though due to my probation. 20 isnt wreckless driving, so dont worry.
