Fraud or Not??

This might be long but i'll try to make it short as possible, sorry if it is long...i went to a cellphone dealer (At&T) to upgrade my plan to a family plan..the dude gives me two phones, one to replace my old phone and the other one for the new line. He told me that I'd get activated within two hours and they would text message me the phone number for the new line. Few hours later my cell phone goes out of service, iam like, wat the F***...i call up AT&T, and they tell me that there was no plan or new cellphone account formed under my account...the next day i go back to the sales rep. all pissed off n shit, told him that he fucked me up...after few exchanges of words he gives me this phone number that was supposedly for my second line..at that point i told him that i wanted to cancel that second phone line and also the reason being for my fone to be out of service was that, he activated the SIM card that the new phone came with and deleted my old SIM card that i originally had, but the fucked up thing about it was that he kept that SIM card that he activated, (that was told by the at&t rep.) so he finally gives me back teh SIM card and my phone works fine, and told me that he can't cancel the phone and i would have to call up At&t and cancel it myself..and lastly, when i called up At&T to cancel it, they told me that the number that he gave me for the second line was being used by someone else..i asked him for the name of his manager or his supervisor, he wouldn't give it to me..so my quest. is, should i file a complaint w/ the BBB or the DA's office???? Do i have a strong case against this guy??? Sorry guys if its too long, iam just kind of pissed off about this whole situation....

ya thats fucked up...i hate fuckin people who can't do their job..get a new fuckin job if you can't please the customer

at&t dealers dont really have all the computer tools that a direct store may have. so essentially, an entire activation is done over the phone. at&t's billing system is extremely prone to delays when activating new service manually, especially thru its gsm network. a wrong sim id or imei number can delay an activation for days. maybe it was just the rep's error. i dont think he'd gain anything financially for creating a fraudulent acct.

when my girlfriend got her gsm demo line from at&t she was issued given the phone with a california number for some reason. apparently, the sim id was a digit off and activated someone else's phone number in new jersey. she used the phone for a month before it was shut off, she thought the whole time her cali number was legit, but it was actually issued in error and nothing was ever billed to her.

barking up a storm to the bbb will acheive nothing worthwhile. i'd call up customer care and bitch till your face goes blue and demand proper credit on your acct for making you go through all this hassle.

All i want to do w/ the bbb is for that stupid rep to realize that he was messing w/ the wrong guy. Alof of people don't take the extra step to do anything, and thats how all these people get away w/ fraud n stuff, but i dont know if it was fraud though, but how about identity theft or something, he had my credit card # and my license and all that, along w/ my S.S. #....

its pretty much standard for him to ask for all that personal info. some people are more weary of it than others. if u want to make a point to the rep, talking to the bbb wont help. talking to his manager or supervisor may be the appropriate way to have it be known that he fucked up and should have at least tried to help you out. sounds like all he wanted to do is make the sale and if something went wrong, u were on your own. salespeople are only as good as their reputation.

bbb wont act unless multiple complaints have been made against the same vendor for the same thing.

I asked him for the name of his supervisor, he said that he can't give it out, then i asked him if there was a manager and he said that he was the manager, i knew that he was lying, cause a manger would never treat a customer that way, not to my knowledge atleast..thats wat got me pissed off the most...

Yuppie is right...about all the att stuff...and that is it is probably just a mistake...its pretty hard for a dealer to perform fraud..considering everything is tracked with sim id's and dealer codes...so they pretty much know who did what to who's account...

also bbb will pretty much just send the store a letter stating what you dictated to them and see if they can be the middle man and resolve the situation....the store will either deny it or say they want to help resolve the problem..and wont be able to do much since its out of there reach and all on att's service..

just a heads up...find out the owner of the store..its not that hard...(call up att direct, they have agent codes, they can be tracked by master dealer, or owner of the store..ect..) and do what u gotta do...but make sure u do the right thing before u look like an ass...

ya thats wat i'll do, but the thing is that they're the third party, he wasn't a direct at&t dealer, so that kinda put me in a deep spot too, well, i'll try calling them up too...thanx guyz, appreciate the help...
