Anyone ever filed a claim with the NY comptroller for damage caused by pothole?

I hit a ridiculous pothole last night on the staten island expressway. If youre driving on it avoid the far left lane between mile markers 10 and 13. It bent one of my wheels bad and cracked another, and it also looks like my front LCA compliance bushing is completely torn all around. I took it to a tire shop and they couldnt even attempt to balance the wheels, they are all over the place. I found a form to fill out and file a claim with the NYC comptroller here:

http://comptroller.nyc.gov/forms-n-rfps/filing-claims/

I just figured I would check and see if anyone has had any success doing this in the past. I have a dash cam with video proof that I hit this monster pothole, and there were about 10-15 cars pulled over on the side of the expressway right after the pothole, I assume because they hit it too and got fucked up. A couple cars were on tow trucks. Ill post the vid up here if I can figure it out with photobucket.

Keep us posted how the claims goes.

I am also thinking of getting a dash cam and I have a few questions to ask if you don't mind.

1. is it legal in ny?
2. what brand/model cam do you have?

Thanks

I dont see why it would be illegal to have one. I have a cheap one from DVRyourCar.com. I paid like $90 for it but you can get the same one for about $60 on amazon, you just have to be careful and make sure it isnt a fake

I just filed my claim online, it says it will take around 30 days just to confirm that I filed a claim.

Good luck bro! I remember in my 3G cracking and bending 2 entire sets of those stock 5 spoke 17"s. Wish I knew filing a claim and potentially being reimbursed was an option. Keep us posted, post that video and good luck!

https://www.dot.ny.gov/divisions/leg...on/smallclaims

This statutory language generally means that it must be clearly demonstrated that the State, although aware of a dangerous condition on the highway, did nothing to remove the hazard, subsequently resulting in damages to a user of the highway.
I wish you luck but this is where they can claim they were not given sufficient time to either block the lane from traffic or repair the damage.

You can also read this to learn more about their responsibility.

I spoke with someone and they said a letter was sent a month ago "disallowing" my claim, but I never got a letter. She basically explained that it was not their jurisdiction and she referred me to the NY DOT website here: https://www.dot.ny.gov/divisions/leg...on/smallclaims

So I have to fill out a whole different form and wait 6-8 weeks to hear back again. If this wasn't exactly what I expected I would probably be pissed, but Im used to getting the runaround from this horseshit government 'cause I worked for it.
