Yes, it appears that you have been wronged, but by bringing other parties into the matter that have no financial or direct interest, you will only afford the dealer an opportunity to argue that you are not interested in reaching a solution. You have, most likely, allowed the dealer to represent themselves as the wronged party, forcing them to defend themselves. When you defend yourself as being the victim, you don't always need to be concerned with factual information.
Again, this matter is between ONLY you and your attorney, the dealer, and ebay. No one else should be involved.

the more he lets out, especially if he's cross threading, the more he'll be more likely to get confused and slip.

I will put a fight, and argue til i'm blue in the face... I was thrown out of a 10 minute Oil Place (had the cops called on me) and I made a huge scene at a Mavis Tire (both places tried ripping me off/f!@king me over)
In the end, If somebody had my car in their possession, while i started a pissing match.. i would be weary about getting that car back the way it belongs
OP- be sure to bring it to a nissan dealer, pay a fee, and have the largest multi-point inspection done possible

If it was me, I seriously would not want that car after all that's happened. inspection from another nissan dealer or not, they still could miss something the dealer did. But congrats anyway. Hope you enjoy it.

It would be completely stupid for the dealer to mess with the car after the shitstorm they created by just not honoring the price. Imagine what would happen if it was discovered that they intentionally tampered with it. Especially if it put the OP's safety at risk. It'll cost them a hell of a lot more than $3900.
