Need Advice BAD!!

I was driving back home the other night at 1:30 am on the 101 South, where the road was completely empty with a straight road ahead of me. As anyone else would I was going pretty fast (triple digits) w/o really noticing and after 5 mins i get pulled over by highway patrol. I got written-up with no reckless driving or anything. Just a speeding ticket exceeding 100 mph. Can u guys please help me out on how i can fight this ticket? I can't risk getting my license suspended.

dude you were lucky. after 100 they can impound your car and throw you into jail. How much is the ticket? I don't see how you can fight this ticket if you are at fault

You got off somewhat easy on just a speeding ticket. Consider yourself lucky. Have you gotten an ticket before for speeding? If so, you're an idiot and deserve to get your license suspended because obviously you haven't learned. There really is no way of fighting this ticket because of the speed you were cited for. Take it like a man and don't be dumb again.

First off, yeah, I've gone 100+ a time or two, but I was well aware of what I was doing...no one accidentally goes 100 without noticing it.

Secondly, I would say you got off easy, what are you going to fight about the ticket, you should already consider yourself lucky.

If you can't risk having your license suspended, what the fuck were you doing going that fast to begin with?

ah, another "speeding" thread where the OP thinks he's gonna get constructive advice on the subject...e-money, tough luck getting pulled over doin 100+...you'd have a better chance of getting a sympathetic response from hitler than anyone on here bro...take it on the chin, pay your fine, slow down...pretty much cut and dry

sorry i can't really help,

I'm not sure if speeding, even in excessive numbers, would result in a suspension unless convicted of reckless driving as well. I think it's only after a certain number of points on your record where it would be suspended, but I really don't know. If you require to drive for work, I believe they have a restricted license you can apply for which might allow you to drive to and from work.

Don't even attempt to fight it. You're lucky you didn't end up getting the car impounded and your ass thrown in jail. Just pay the ticket and slow the fuck down, dumbass!!!

You're screwed. If you are able to get a lawyer to help you fight that, it will cost you a ton of cash. And if you face it and take the points you are basically the luckiest SOB if you're still driving.

100mph+ is 2 points on your license. Last I checked 4 points in a year gets your license suspendedin CA. Hope you've been a good boy prior to. Oh, and have fun with the ticket cost...it's going to be close to a G, if not more.

Can we make a rule here on A-zine?

How about this: If you get a ticket for speeding 10+mph over the posted limit, you're on your own and don't come here?

I understand if you get one and you're doing 43 in a 40 and the cop is just being a prick; but getting advice depends on the circumstances (speeding in a school zone, etc)

And 100 on 101? Isn't the limit there 65? 35 over plus? You're out of your mind looking for help here.......

what happens if/when they dont show you the radar/laser gun with your speed? does that give you any leverage in court or what?

I ask because there was a lady in court when I went to fight a ticket (8mph over, which I won btw) and she said she asked to see the speed on the officers radar gun and he refused to show it. The judge didnt even bother with it, the judge then listened to the officers side (which was the same officer who gave me my ticket btw) and concluded the lady was guilty

How's your record? If it's clean fight the ticket. Plead it down to a lessor offense/reduced fine. I laugh when people say "your screwed" ,"Hire a lawyer","just pay it"

1. There's nothing really to fight. He didn't get you with reckless driving so theres no official (misdemeanor) charge against you. My girlfriend got a ticket for going over 95 on the 5 freeway driving back from Berkeley and she had to pay an expensive fine and had her license suspended for 3 months.

2. Sure you can argue the ticket, but all you can do is pray that the CHP officer doesn't show up. And in CA, CHP's will always show up to the courthouse when they're called in. They get time and a half (overtime) pay and reasonable fees (including gas and food). And if I were that CHP, I'd probably show up to court to sit in your hearing for 15 minutes, and claim that I had to spend at least half the day there to get my overtime pay.

3. I'm a soon to be lawyer in CA (just graduated law school in CA) and I work at a firm that handles DUI's. If you called me about this problem I'd tell you: "Laws are put in place to protect the general public and yourself. Be thankful that you didn't cited for reckless driving. Just pay the ticket and see if you can get a restricted license to atleast drive to and from work. But I won't be taking your case."

And if you really wanted to get a lawyer, I'm sure you can find some greedy shmuck who'd take your case but I'm certain he will ask you to pay $3,000 up front for representation, and the best he'd be able to do is get you a reduced fine, (but that's after paying him $3,000 so you would end up paying more), a restricted license to drive to work and thats probably it. From an attorneys point of view its an easy $3,000 made from less than two hours of work.

Think about it, what is there to fight? Did the cop do anything not within his power? Did the cop pull you over for no good reason?

Oh man. I can just imagine what a field day a judge would have if you showed up in his court trying to argue that you shouldn't be found liable for clearly breaking the law. Thank God you're not in Orange County, where the judges will shit down your throat if you tried to fight this one.

You broke the law, you got caught. Live, learn, move on and go buy yourself a Valentine radar.

1. Don't get caught speeding
2. In my area you can go in and talk to the cop and get it reduced to a lower speed 90% of the time. My friend has had three tickets that he has done that with now. I don't know if it is a PA thing or not.
3. Don't speed.
4. Don't speed, its not worth it.
5. Go to a track if you want to go fast, if you can't afford it don't do it.

If I got caught for doing 15+ they could take away my license because of the CDL part. One time = three months.

You willfully speeded...and no, not everyone who gets an open stretch of highway in so cal busts triple digits.

You got busted speeding.

You can't fight it. You were lucky you didn't get reckless driving and your license immediately taken away. Count your blessings, pay the fine and the court costs, man up, and stop speeding like that. You're endangering everyone else on the road too.

A little OT- but how are you going to be making $$ as an attorney if this is how you plan on practicing? I applaud your ethics but people are coming to seek your counsel and you are turning a potential client away

I'm not saying fight it to get out of it, I'm saying fight it to maybe get a reduced fine & maybe no points. You have rights. Just because you broke a law doesn't mean you just give up your rights.
Not every PD or every judge is out to get you.
Our legal system is this way, use it to your advantage.

Every ticket I got I have fought to some degree & had them thrown out or reduced.

I got a ticket for doing 110(probably more) 7 yrs ago, I blew right by an unmarked car on the highway. I knew I didn't have much to argue so I cooperated and even admitted how fast I was going. I did request the hearing as I figured if I didn't my license would get suspended. The cop and judge agreed to reduce the speed to 30mph over the limit, 31 is where the big offenses kicked in. Cop had no problem doing so since I was "so cooperative" as he put it. Was done in 5 mins, I paid a $250 fine and was on my way. I haven't gone that fast since.

Don't know if this helps, but maybe they will work with you as long as you weren't a dick.
