Gonna play devil's advocate for a sec. Try looking at this from the dealership's and BMW corporate's point of view. You bring your car in with a complaint. It's a pretty bad one, so they go and take it out for a few days. Longer than any average tech drives a car to find a problem.

If they can't find the problem, there really isn't anything they can do. Not like they can start handing out full refunds for a used product with thousands in depreciation, for a complaint they can't even replicate.

I know and i completely understand, but if i were them i wouldn't risk it ,since i brought the car over 4 months ago for the same issue, and they didn't do anything then and now it happened again without injuries or damages, should be a lifesaver for them,because they should of took it serious the 1st time , and not just say we cant find it so take it back until it happens again -.-. Im not going to let them do the same thing again , im not taking the risk even if they want too.

Yea your right, all they do is drive it and say nothing is wrong with it, i drove it for 4 months without anything going wrong, and then it happened again, i think they need to check every connection in the car, it must be a electrical problem.

There was one loose connection in my TL under the front passenger seat, and because of that , every time the wire would go loose , the passenger seat controls and airbag would get shut off along with the rear passenger side window.So i'm just saying they aren't looking hard enough for the problem, i might as well just take the car back and if it happens again, ill just sit back and see what happens because thats what BMW is doing.

I can definitely understand both sides of the argument; however, I'm still gonna be more sympathetic to Dave.

I would be a little suspicious if:
- He financed the entire amount
- Wanted a full refund
- Would not accept another new M3

In his case, he put down 50k! Chances are pretty good if you can put down 50k, you'll be able to afford the $400 -$500 montly payments. And he's willing to take another M3 so it's not like he has buyers remorse and wanted to find a way to get his money back.

I don't know what it cost for BMW to make the M3 but the "loss" for them will be a lot lower than Dave's 70k+.

Thanks a lot man, they just want to drag this out as long as they can, i guess i would do the same if were them , but im sticking to my guns and waiting it out.

Soon or later, they will have to budge and make a move, and hopefully its in my favor.

But so far BMW has given me the worst ownership experience ever, i'm very disappointed with the service i've received thus far =( , especially with this being a new car 70k car and also this being a very serious safety issue.

THEY FOUND IT!!!!!!!!!(IN YOUR FACE CRAZY ACURA for thinking that i was making this up)

The regional tech was able to duplicate the problem, and was able to pinpoint the exact cause of it , it was something broken in the steering rack.The director of operations at Hassel BMW called me up with the news , he also apologized for all the troubles and lost times that i've because of this car.He said they are going to order the rack and fix the car and also try to work on a compensation package to restore my faith in the BMW brand. Then i mentioned about a few other things other than the steering issue , and he agreed that he would feel the same way i as do too.I mention that i spoke to a lawyer , and i told him that the lawyer said i would be able to get a new car because of everything so far with the car.He said their is no reason for a lawyer in this matter , and that he is going to work with BMW to ensure i get what i want.So he said he's going to call me back monday and give me a update.


Now i can sleep in peace , cant wait till monday!!

Dave - That's GREAT news!!! Man, what a relief - I can't even imagine spending this kind of money on a car and having this happen to me. I don't think I could have been as calm as you.

I hope they come up with a VERY good compensation package for you!

Awesome Dave, I'm glad to see after following this thread everything is working out in your favor.

Anyone know if BMW/Mercedes/Audi will really fly techs in from Germany for one specific car? I've read about it before.

I actually told him , the only way ill give BMW another chance is if BMW gives me a fresh start with a new car, so that will be the best compensation package for me IMO. I dont think im asking for much.

Haha you know what's funny? Last Sat my friend Vic and I went to the club to meet up with his patient who, BTW, is a service technician at BMW. Couple sales guys were there too. I dont think I would need to go the lemon route, the director of operation at the dealership said we can resolve this without one, but the lawyer will always be a back up plan, if things go south with the dealer.

I think he was just quoting what his lawyer said in that he could get a new M3 if they didn't fix the issue at hand. From what Dave is saying, I think he's getting his car fixed along with some compensation for the trouble.

I did, but its going on 4 weeks to get it fixed, and he's the one who offered compensation for all my troubles , so why not take it? what would you do if you were in my shoe?

Yea I spoke to a lawyer he said since the cars been there for so long , and for so many issues , that if I want to lemon it , that I would have a 100% chance to win, so BMW is trying to avoid that, by giving me a new car without going the lemon route cause they themselves know im entitled to a new vehicle if I decide to go with the lawyer.Ill take then new M3 and just start fresh with them , hopefully no problems ,and hopefully my old car finds a good new owner, I loved it , minus all the troubles it gave me.

although I didnt contribute much here since I dont have much dealer experience I followed along. Glad to hear everything turned out great!

DEALER CALLED ME BACK !!!

He said they are going to take me out of the car ,and that he wants to meet me up 2morrow to make a order =D

Thanks bro, I'm so happy that all my money didn't go to waste, all i'm losing is my tints =(, but I have to call them back since I have a few aftermarket parts on the car that I would like back( ZCP CF spoiler , ZCP CF splitters , rubber floor mats, rubber trunk mat, black front grill,black side grill and black hood vents) , I think ill let them keep my seat covers, I hated those things for staining my seats.
