Got a speeding ticket on I-880 to Gilroy
I'm so upset. I just got onto the freeway and steadily merged 4 lanes to the left to reach the carpool lane. just at that moment, CHP pulls me over and gets me RIGHT as I touch 80 MPH on my car. I just got on the damn freeway for barely 20 seconds and I get pulled over. so my ticket is an 80 on a 65 highway. do you guys have a clue as to what the damage is? i hope it's not over 250.

My uncle is a CHP and he said 10mph is not that big of a deal and he rarely tickets at that speed. Driving 78 is kind of pushing the limit, but as long as your not endangering anybody and the traffic is light than you should be ok. However, this all depends on the officer and how good his day has been going.

i'll keep you guys posted on the total amount. it sounds like it's gonna be around 290 after everything + traffic school tuition.
watch the hell out on the highways, guys. i literally touched 80 for about 5 seconds. when i got the ticket at around 10:30 AM, I saw about 3 other people getting pulled over on my way to Gilroy Outlets. When I was returning to SF, I saw about 10 people getting pulled over.

So I called the Santa Clara County Court this morning and the clerk told me I'm going to have to wait up to 60 days for the courtesy notice to know how much I'm fined for. However, I went to this law forum and asked the guy who seems pretty reputable from that forum.

In California, it starts out as a "base fine". Then several different amounts normally referred to as "penalties and assessments" are applied (added)regardless of how you proceed with your case. So you're not saving anything by not fighting it, but you're not adding anything if you do!

Well, for future reference, the vehicle code section you were cited for violating specifically states:
22349. (a) Except as provided in Section 22356, no person may drive a vehicle upon a highway at a speed greater than 65 miles per hour.
... As you can see, it mentions nothing with regards to a time period. So it doesn't matter whether you exceeded the posted limit for 2 seconds, OR, exceeded it for a half hour, you are in violation and can be cited.

Read the courtesy notice very carefully. Try submitting a trial by declaration. The officer has to submit a written response as well. If the officer fails to file the response in a timely manner, you automatically win. If you lose the declaration process, you are still able to request a court trial. Then the officer is required to show up in court. If he/she fails to show up, you win. You essentially get two bites of the apple so to speak. If you lose in court, make sure you still have the opportunity to attend traffic school. Then and only then will the citation by deleted from your driving record.

-i live in san francisco, and i got pulled over in santa clara county.
-court appearance is dated on july 28th....but i'll be in hawaii.
if i change the date, it'll more than likely conflict with my work schedule...i work at a school from 9-6 PM. in addition, i'll be taking night classes as well... i feel like i should just pay it.
