OK...so here's what I've gathered after a day:
- if I get an attorney & fight it & win (which will take a minimum of 2 trips and up to 4 or 5 up to Tyler), all that does is dismiss my ticket. I understand that it's the damage payout that will cause Geico to raise our rates, not the ticket, etc. If my ticket gets dismissed, I'll still have to start a lawsuit against the girl to prove that it is her fault so that I may file on her insurance. That's another trip or two up there, plus a bunch of arguing I don't feel like doing.

- if I suck it up & just deal with everything, this is what I'm out:
- ~$100 for the ticket
- $250 for the deductible
- ~$40/month for the next 3 years in raised rates. this is the biggest estimate due to the nature of the insurance claim process, but should be a good, conservative estimate.

All in all, the $100 for the ticket is negligible & would be a couple times going out to eat that I don't need anyway. The $250 for the deductible will probably not be a concern due to the family friend that will be doing the body work, but is also a fairly small amount of $. The $40/month is ultimately not that big of a deal either, since it's only a bit more than 1 hour of work per month dedicated to paying extra premiums. I think I'm just going to take the easy road & assume responsibility - it won't kill me & my time is much more valuable than going up and down the road to Tyler & back is worth.

thoughts?

You really dont need a lawyer at all for a traffic ticket, waste of money. And it may only take one visit to the court for the ticket. When you go you will meet with the prosecutor and he'll more then likely drop it down to the next level down, usually half the amount due, or just dismiss it out right.

Also i looked up the fine for YROW, in Seguin, TX, (i couldn't find a general one for texas sorry) it is $180 fine.

but you are right, it might be cheaper just to suck it up, then spend money on gas driving up and down, and a lawyer fee if u decided to get one.

As for quotas, its a myth that almost EVERYONE believes, there is no quotas in law enforcement, in some jurisdictions it is even illegal. but then again, its not unheard of for LEO's supervisors to set "Daily Ticket Performance Standards" but thats few here and there

anywho, sorry about the crash good luck with the repairs Rev!!

I got a failure to yield ticket about three years ago. The fine was $120. So its definitely not going to be in the $1,000 or anything.

It was from HPD.

I hate it when I hear stories of people getting into accidents and there's a third party who lies to the cop in the favor of one party, so the innocent people get the ticket/fault. Hope you get this resolved soon.

Karma's a bitch....

sometimes cops can be real turds. i'm sorry if this offends some cops who are members but i'm a firefighter and i realize there are firefighters are there that are worthless too.

I hope if you had a digital camera or "throw away camera" you should have taken pictures at the time of accident. the the reason i say this is Photos can help explain to a judge why you feel giving you a ticket is B.S.
anyhow,what i'd do if i was you is 1 of 2 things
option #1. hire a traffic Lawyer explain to him/her what happened and how you feel you unfairly cited for the incident. probably go to court and hopefully win.
option #2.(and a little cheaper) defend yourself in court.

Just an update, at the request of an MM...we drove the car up to Tyler Friday & dropped it off at the shop Saturday morning. The reason for the 4 hour drive is the guy that's going to fix it has repaired all of my family's cars for years & years, including those that my dad had work done on when he owned a used car lot.

PS. If anyone needs work in or around Tyler, I'd recommend him & his work all day long on any vehicle you have.
