Another Accident Question & Good Cop Story

I was at a friend's house, legally parked in front of her house but on the street. We happen to be looking out the window just in time to see her neighbor back into my car. The lady stops so I put shoes on to go out and she takes off

Tried to talk to the lady when she got home but she said there was no damage (her back bumper corner was caved in and my fender is dented and wheel is scraped to hell) and she ran inside so I called the police. She admitted to hitting me but was rude so the officer threatened to arrest her for leaving the scene if she didn't shut up but ended up giving her three tickets.

Cop was super cool and said to file with her insurance but they may say I was a contributor since I was parked in the street even though I legally can and many do. He told me he put her at full fault and I BSed with him a bit, really really good experience with the police over all.

Question is, do I file and with my company or hers like the cop said? The reason I ask is because while the damage pisses me off, it isn't bad and I dont want my insurance to go up so would prolly just fix it w/o insurance but if her insurance is paying, great. Honestly, I felt bad since the lady was older and I just wanted an apology or a freakin note but she kept blaming me so screw her.

Really dont need this, found out my company can't afford me last week, owes me about $8k and who knows if they will ever pay (not looking good). Life is really sucking lately so I don't want to claim this if I'm going to end up paying for half or something

The last time I had an accident I called up the other party's insurance company and faxed them the police report (other party at fault in similar situation, but FL is a no-fault state). They said everything looked in order and to go to two shops of my choice to get an estimate. I went to the dealer's shop and an independent one and faxed over the estimates.

Company looked over it and said that it looked a bit high for what it was and told that they would look over it again just to be sure. A day later they said go to the dealer's shop (which was ironically more expensive) and that they would pay the dealer directly and have a loaner car there for me.

As far as your work goes, I'm sorry to hear about that, have you talked to them about it? Do you have it invoiced or anything that they owe you 8K?

Work - Expenses that they said they would pay, have all receipts and expense reports and will wait a bit to try and go the nice route. I just took this job and left a job for it grrr This combined with my other thread in ramblings for an effing terrible time

Ouch, sorry to hear about everything going on. My last job is screwing me over too, not fun

If I were you I would just go through insurance. As long as you haven't had anything else filed through them within the last few years your rate shouldn't go up. Back in February I filed a claim for the second time in 4 years and nothing happened.

Yeah FL job market is the suck.

Then call her insurance. Her's will have to pay for your car.
Just as above they will either request a copy of the police report from you, or get it from the PD directly. They will either ask you to get quotes or send out their own adjuster to go over your car, & then whatever it costs, take that to any repair shop & they have to fix the car for that amount insurance said.
Your insurance will not be going up because she's at fault & her's has to pay for your car. Minus your deductible.

You saw her hit your car. She admitted fault. The cop gave her 100% fault.

And you are not sending it through her insurance, why?

Of course you claim it with her insurance. And don't forget to ask for diminished value, too. Minor incident or no, that dent will drive you bat-guano. If she hit your wheel (you said it was scraped), have your dealer or a body shop inspect the suspension, too, to make sure that no components were damaged.

File a claim with her insurance for sure, your premiums should not go up because of this.

Doesn't matter that you were parked on the road legally --- it's the driver's responsibility not to hit obstacles while driving.

and if your car is parked and hit i dont think they can raise your rates. At least they cant in texas.

Why would her insurance charge him a deductible?

Even if you reported the accident to your insurance, you would not have to pay the deductible because the other party is at fault.

But as others have stated, go through her insurance to get your car fixed. Your premiums won't be affected.

Someone hit my parked car and sped off. I wasn't lucky enough to catch the guy and no one was around to witness it so I had to pay my deductible but my rates didn't go up.

Thanks all, called her insurance and they said she said there was no other car involved but were very nice in taking my info. They said an adjuster would contact me today and that they were sorry for the inconvenience.

Hope it works out but it sounds like it will. The officer was def on my side but again said her insurance could fight saying I "contributed."

dont buy that bs. we had an insurance try to pull that on us when their party ran a stop sign. they claimed that we were speeding and thats why we hit the lady that RAN THE FUCKING STOP SIGN

ended up sueing the company and walking off with about 25k

Her insurance company will try to intimidate you. I got rearended in my work truck a few years ago and that person's insurance company told me that they wouldn't cover my chiropractor bill due to the fact there wasn't much damage to my work truck (even though the van that hit me was demolished) so i told them that I will get an attorney involved they said fine, in the end they paid all my medical bills and payed me $1500 for pain and suffering... LOL

Quick update - Her insurance company had my number wrong but I finally got a hold of them and a super nice lady called me saying their driver was at fault and they would take care of any damages my car incurred.

Looks like one thing is working out for you at least. Did they say anything about diminished value?

How are they going to get a quote? Will they send an adjuster, or can you go to the shops of your choice?
