Good that you walked away unharmed! I'm curious about the Lexus you were pushed into. Are you responsible for repairs or is the owner of the van liable?

If it works out like my wife's accident in which she was in the middle last year, the OP will face no or minimal liability.

In our case, the driver who struck my wife was at fault. However, the person my wife hit causing a scratch, sued everybody. At the end, our insurance paid $600 in our behalf out of the $50k they were asking for from us. Stupid greedy plaintiff....the lady who hit us died from her injuries and her estate had to pay.

Wow, so sorry to hear and this really sucks but the important part is you are okay and the car did its job for sure!

I agree and I have some experience with car accident scene investigations and 60mph would have been way uglier than this, I am thinking 30-40mph as well. And modern cars are built to crumple to absorb the impact energy (along with lighter materials as well) so even accidents at slower speeds can seem quite ugly when you look at the vehicles.

The car may not be totaled. The repair costs don't need to equal the remaining value, usually only some percentage (maybe 70%). Unless the engine is damaged it may not be totaled. The frame can be straighten, doors replaced, repainted, etc. I'd be like you, I'd want it totaled too. Hopefully you have some good insurance. The insurance company could go after the van company for damages due to their employee negligence.

Fair point, but those claims can be a gigantic pain and not worth your time and very few states have a solid case precedence with those types of claims.

The reason I said the van was going 60 mph was that when I got out of my car after the crash, a man approached me and handed me his business card. He said he was a Dr. who "specializes in cases like this," he was driving right behind me and witnessed the accident. He told me the kid was going about 60 mph and ran the stop sign.

I'm not responsible for damages to the Lexus since I wasn't the cause of the accident, even though my car was the cause of the damage.

I called the van owner's (he wasn't the driver) insurance co., Foremost, to file a third-party claim. They told me he only has $25K coverage for damages, not nearly enough to cover my claim and the Lexus owner's claim. Therefore I'm filing through my carrier, GEICO, and they will try to recover my $500 deductible from Foremost.

Foremost also said I also the policy might not cover the accident because the driver of the van wasn't listed on the policy, and since I told them the kid said he was driving his supervisor's van, Foremost said the van wasn't insured as a commercial vehicle so he might have been using it illegally.

Thankfully you were able to walk away. Good thing no one was in your passenger seat. I'm guessing they wouldn't have made out as well as you did. Hopefully they write it off. You're right. It will never be the same.

Glad to hear you are OK. An EMT was in the car behind me when a DD ran a red light long time ago. I don't think the car will not be totaled. The important thing is that you are OK.

Glad to hear that you are okay! Very scary as I similar incident happened to me almost a year ago. Kid texting ran a red light and hit our RDX which then bounced off a Tahoe.

Anyways, please to get checked out by a doctor and seek legal representation.

I just got my settlement check from Geico. I was hoping to pick up my new TLX V6 Tech SSM/Ebony tomorrow, but I don't think the funds will clear by then. I might have to wait until Monday to pick up the car.

I can't wait to get out of this rental, they only had a GMC Terrain available and the car is driving me! I can barely reach the gas pedal.

Geico paid for a replacement vehicle based on the age/mileage of the car I had, so bottom line is I'm out $5K for the new car. That really sucks, but nothing I can do but move on... I'm just glad to be alive.

Thanks for all your support through this ordeal, you guys are the best!

Few years back my mum was in an accident in our family 2000 TL, T-boned like narnia but on the driver side (mum was driving) ! it was at low speed like 40-50 km/h (my guess only, i wasn't there at the time of accident) side air bag deployed on the seat (i didn't even know the seat had a side airbag). my mum is a very petite woman and gladly she wasn't hurt at all. only some light scratches from shattered glass. since that day, i was so thankful to acura and just made be believe in them even more.
