Hit over the weekend
I'm embaressed to say this considering the business I'm in and the amount of experience I have relating the matter. But I've never even thought of a diminished value claim. Where'd you come up with the idea for one?
The courts Washington State say that if you're in a wreck and the accident was not your fault you are entitled to file DV claim. That being said, each state must be different.
What I do know is that your insurance company will not even mention it even though they wont be paying a penny of it unless the drive that hits you is under the same company.
Ive had not at fault accidents with drivers under the same banner (GEICO) and they never said anything. But then again geico is terrible so that doesn't surprise me, what a relief to have teir 1 ins.
I have no problem with your lawyer getting his fair share. You probably would have gotten less from the Ins. Company w/o a lawyer. But, if the loss in value was $10K, should you have gotten that amount plus attorney fees?

In a perfect world yes. But this is an independent appraisal, the ins company most definitely will disagree with the amount and legal fee's aren't included in this types of cases (NF).

If I attempted to do this myself it would have been tied up in their system for months if not forever and most likely I would have missed something and received nothing at all.
Since it didn't go court I'm assuming the lawyer fees would be an unreasonable request to the Ins Co.
