Problems with driver memory settings with key fob

I purchased my 06 tl about 5 months ago and it had an aftermarket remote start already in it. It did not come with the factory key fobs so I only had the remotes for the remote start. Im not really a big fan of the remote start and i wanted the factory remote for the driver memory feature. I just purchased a driver 1 key fob from ebay and I was able to get it programmed to the car and it unlocks and locks it ok. When I link it up for the memory settings it will only unlock and activate for driver 2 settings. When i unlock the car with the key or with the remote start keyfob it also unlocks to driver 2 settings, Does anyone have any idea why this will not unlock to driver 1?

Is the keyfab a driver 1 or driver 2 key fab. should say on the back "memory 1" or "memory 2" Sounds like its the Driver 2 key fab which is still ok.

The back of the remote says memory 1 on it.

you purchased it from ebay.... it could be anything then. Maybe internals from a memory 2 and case from a memory 1. Try reprogramming it. There should be a tread around somewhere. you cycle the key from on to off 4 times, when in 'on' push one of the lock buttons on the remote, at the 4th time you should hear the power locks cycle and then hit the lock and unlock botton on the remote. Maybe that'll work. Otherwise is it something you can live with??

It is supposed to be a "new" remote but I am starting to think maybe it is a memory 2 remote in a memory 1 case. according to the seller they claim that you can make either remote work as memory 1 or 2 depending on which order you program them. as i read through some other posts on the keyfobs it looks like that might not be the case. I was just hoping that somebody might now of a way to make this a memory 1 remote even if it requires going to the dealer. I want a memory 1 and 2 remote and I was hoping that this one would work as 1 since my remote start remote works as memory 2. my wife would be #2 and #1 for me.

I opened up the remote and I found a fcc # printed on the circuit board, It is differant than the one that is on the case. The Number that is on the case is oucg8d-387h-a, the number on the circuit board is oucg8d-344h-a which looks like it is for a honda and not an acura. maybe this is my problem.
