Why didn't you call the cops and insurance at the scene of the accident?

Call your insurance co and check if you have a thresehold or no thresehold. Here in Jersey, If you have a thresehold you won't be able to sue and I won't get into the limited exceptions.
We choose to have no thresehold, but with the 3 cars we're paying $3800 a year in the great state of NJ, no accidents, points etc. No thresehold jumps the yearly cost up considerably.

Your insurance company will be responsible for all the medical bills, while the guitly party will be responsible for the repair of the car. If you can sue, good luck.

you didn't include this in your original story.
Turbo gave great advice.

*edit*
Don't assume, if youre planning to sue. Call your ins co. and find out for sure. That way you have all your bases covered.

Full coverage has nothing to do with the thresehold as it is independent of liability, collision and comp.

Wow must be nice...out here in cali you cant get a damn police report. Unless someones drunk or high or if city property is destroyrd or if someone is unlicensed....I was involved in an accident where my back was injured and I found it much eaier to get an attorney...yes they take part of your money but they worry about alll your hassels and usually have good conections in the therapy industries so you will be taken care of either way. Plus they can usally get you some pain and suffering and even some lost compensation if you missed work cuz of this accident
