My formal letter of complaint

I finally spoke with the regional manager from Acura and his offer stands at the reimbursement of last months bill to compensate for the loss of my car for the month (and still counting since I have yet to see my car). My counter offer was an extended warranty and an A-spec package but he didn't agree. I told him that the value of what I wanted is similar to the 30 day loss and the TWO trips to the body shop. He saw it differently stating that a loaner was given to me during the absence of my car. I am getting too tired to continue this BS with them and I miss my car sooooooooo much, so more than likely I will accept the reimbursement and send out the following letter:
If this letter gets read by many people then that's good enough for me. I just would like everyone to be aware of what the Dealer and Manufacturer can do to you. I was told my car will be ready tomorrow, so hope it is. Thanks for your time in reading this.

My name is ####. I recently purchased a brand new 2004 Acura TL on March 27, 2004 from Thomas Acura, West Covina, California. A couple of weeks of owning the car I noticed a rattling sound in the back, right side near the back seat. I’ve contacted the dealer about the issue and was advised to come back when it’s my first oil change so that the matter can be resolved all at one time. When the time came, I left my car at Thomas Acura. It has been a total of 30 days that I haven’t driven my car and I still do not have my car.
During this time, my car has been in a body shop twice. The first time was to repair the damages the service department at Thomas Acura left while removing the back seat and the second time was to take care of a screw hole located on the front bumper while preparing my car for deliver back in March.
The first two and a half weeks I never received a call regarding the status of my car. I finally called to determine status. The service department failed to call me to update me on the status of my car and they still have not repaired the problem. At that time the Service Department Manager was not even aware of the problem. They had my car for an extensive amount of time and also damaged it further in the process. After many calls to Acura Division, a complaint was filed. The General Manager of Thomas Acura was also not aware of the issue.
I am truly dissatisfied and disappointed with the customer service and experience I have received from both Thomas Acura as well as Acura Division of American Honda Motor Inc. I am looking for the customer satisfaction that I envisioned Acura was known to provide before this whole incident occurred.

Sounds good. But if your car has been in the shop for over 30 days you have legal grounds to file for the lemon law because those 30 days were spent trying to fix a single problem or two. Especially if they can't fix the rattles and have to keep fixing parts of the car they mess up; that depreciates resale value, or can at least be argued it does so in a lemon hearing.

BBB is good. I have had goood experience with them. The thing is however, if you are still looking into the A-Spec and Extended Warranty, I doubt BBB will get them for you. The bureau is known for being fair to both parties especially if the company is reputable (BBB also takes care of scams and stuff like that where they will lean more towards the consumer) such as Honda, then it is likely going to give you equivelent of what you lost. They compare this almost always by monetary value. I assume you are paying around 300-500 for the car/month. They will probably give you one or the other but not both. Best of luck to you tho

I myself purchased my TL from Thomas acura of West Covina. I personaly had the same rattling issues and was told the same, to bring it in at the first oil change which I did. They had my car a total of 4 days (but they provided me with a TSX) supposedly the rattles were fixed but I can still hear them (rear deck) not as bad I must say but none the less still hearing them. I also had them replace the third brake light assembly because it was sagging, the last thing they replaced was the driver side window regulator which they said was bent and was making a loud clanking noise when I would shut the door with the window down a bit. My experience was a bit different and I have to say they treated me very well and took care of the problems at hand no questions asked, as for your situation it sucks and I hope you get your car back in one piece.

In Virginia, the State Attorney's office has a great claim service - the BBB is a waste of time, but the Va SA will send an investigator out, and the dealers pay attention to them because there is an issue of licensing. They have helped me 3 times, and the 4th time ended up in my suing Mitsushitski, and winning. Check your phone book for listinging under sate consumer affairs, state attorney's, etc. Tell them briefly what you are trying to accomplish (help with a car service) and they will point you tot he right dept if it is not they.
