parking brake problems

Hey all,
I've got a '03 TL-S. The parking brake (emergency brake) seems to have a problem. After i've released it and started driving, you can hear the brake "click" down and start engaging itself. This happens randomly.

WOndering if anyone else has had this problem. I plan on taking the car to the dealer. But i'm afraid of the dreaded "happens intermittently problem, could not duplicate" at the dealer.

Oh when I say engaging itself, this does not engage fully. Just a click here. And a click there. Usually just one click however.

I would think the dealer could fix with no problem. It is probably the return parkiing pedal spring doesn't have enought tension to keep the pedal tight in the upright position. No big deal to fix. Take it to the dealer, stuff like that is what a new car warranty is for.
