Issue at 40 pmh in AM

My TLS that the dealer bought back from me would do something similar to that between 35-40. It would almost feel like it would lose power for a second. They never could explain what it was.....hence i *****ed and they bought it back. Among other things.

Yes, I used to have that problem as well. The car seems to stutter a bit around 40mph.
If you are having a problem where your car seems to lose power at that time, I think the issue is that 40mph is the borderline between a high-ratio 3rd gear and a low ratio 4th gear. Stepping on the gas will drop your transmission back to 3rd gear and give you more power.
If you are having a problem where your car "jerks", then that means your transmission is slow to switch gears. I used to notice that problem a lot (but then again, I drove the HELL out of my car), and recently, my transmission died. It is getting replaced under warranty right now, so I will let you know if the new replacement transmission fixes the problem. If it does, you might consider asking to have your transmission inspected, or you can just wait for the transmission to fail before the warranty expires. I believe that Honda has expanded the warranty to 7yr/100,000mi on the 2000-2002 and some 2003 TL/CL models, as well as the Honda Accords and Odysseys in those years.
