car accident help with a rental

Ok, I'm killing myself here. I rented a car today and for some reason I opted not to get the insurance for an extra $25...I guess because they just got me for $25 under 25 fee(i'm 21). Well anyways, I'm on the way back to Lubbock from Houston and I hit a cow. There were 2 cows hitting the road so I really couldn't avoid it. I end up swiping the back of it and running along the side of the road. Luckily I could drive the car afterwards.

Anyways, I called my credit card because I remember that they have auto rental insurance. Then they told me that it is supplemental to my own insurance coverage. This is where the problem is....I don't have insurance under my name because umm, they kind of rejected me under my parent's policy because I guess I have a couple of tickets. So basically I don't have insurance under my name.

So what is going to happen? The rental car company, National, said that their insurance company will be giving me a call. You think this will come out of my pocket or will their insurance cover it? Or maybe my credit card company will come through? Lemme know wassup.

Sorry dude, sound like you're fvcked.

They willl go after you for the money to fix it. Typically you would report it to your insurance. Since you do not have insurance, you are on the hook. You're insurance company is correct as it is supplemental insurance to your own personal insurance.

Not sure what the laws are in TX, but in PA they will sieze your car if you are caught driving with no insurance.

How did the cow end up on the road? Can't you find the owner and sue him for not having the cow contained? Anyway, if your credit card company won't cover you and you didn't get insurance from National, I think you'll ended up with the bill.

I do'nt know how the cow ended up there. I was thinking the same thing about suing the owner who let them run free. Would that work by any chance?

The messed up thing about this is that I was going slow, around 70 mph. Usually when I'm in the TL I go about 100 on this road.

You should of call the cops and told them to find out who those cows belong to. Now you have to do your own investigation

I'm pretty sure Texas has an 'open range' law in that it is your liability if you hit the cow. So that you will probably owe the rancher for his cow if it was injured, not the other way around. So you're probably 2x fawked.

You could go after the owner of the cow.

Were you renting a car as a temporary substitute vehicle to your parents? If so, then you could use your parents vehicles insurance.

If not, then National is likely self insured to a certain point and you will likely be responsible for this.

If the credit card companies insurance is supplimental, what is it supplimental to. If you have no supplimental coverage, then the credit card should be primary.

i have to agree with everyone......ALWAYS get the insurance. I blew out 4 tires in a Cadillac Deville 3 blocks from the rental place (don't ask) and i thanked god i took the $15 insurance

lol!!! you've got to be kidding us, how could you not have seen the cow? Those things are huge!!! anyways, poor cow.... and poor you!!! Car rental places will usually charge you up the @$$ for stuff like this... that is if they don't take you to court.

Yes it was a substitute for the TL. However, if they bill me I'd rather pay for it somehow.

I mean I saw it, but there were two big cows taking up both lanes.

The credit card company's insurance is supplemental to any existing coverage that I have that my insurance doesn't cover, but I don't have any insurance.

You don't have insurance? Dude, this is getting pretty ugly.....hate to say it, but I think your screwed.

I never accept insurance...By the way..for all you NY'ers, if you have a policy in NY state, you can drive anywhere in the country and decline the insurance, if anything happens, your insurance holder would take care of it.. Aside from that, I always use my Amex card, which covers me like $500,000 worth of liability and damage on rentals.

In IL it is a hidden law that a person is only responsible for $250 worth of damage if they do not take the insurance. Of course the car rental companies will not tell you this.

You may want to see if TX has a similar law. Definitely check on the open range law also. If you were in an area where open range was not in effect I would go back to the owner of the cow.

If you were using the rental as a temporary substitute for the TL, you do not need to have insurance for yourself as long as its for the TL, and you have permission to drive it, unless of course you are an excluded driver.

My friend was sitting at a stoplight on post avenue and the LIE and he looks to the left and a horse was barrling down the LIE service road and jumped over his car and landed on the otherside causing damage to his hood and fender. It then kept on running. What do you do in this case . He went to the police station and told them and they called him a lyer and said he just wanted to make a false claim to insurance. About a half an hour later, a man came in with a leather whip and said his horse through him off and started running. What are the chances??? Anyway, he had insurance on his horse and said that he had too many points so he paid my friend for the damages. So, basically, find out if the cow is insured and see if you can claim money from him...

LOL, now that's funny. But I think I'll see how it goes. I don't feel like investigating this really. I just hope the rental car's insurance covers it. When I dropped off the car I told him i was in an accident and he just said ok. We didn't look at the car or anything.

I believe he means that he is not on his parents insurance... Correct me if I am wrong..He basically borrows his parents car? Correct...I think there is some type of agreement with the insurance companies when you borrow someone's car..For example some one asks to borrow your car..With your permission you are liable for all damages to the car...(Car Owner)...But with rental cars...I think I agree with everyone here...You are probably %ucked! You are correct Mstyle.

Anyways, they are sending something in the mail that I have to get notarized stating that I really don't have Insurance. I hope this means that their insurance will pick it up. The damage isn't that bad though, maybe like 2-3k.

Somebody just told me a story where his Dad's friend hit the cow head on and it lifted the cow up and fell onto the car badly injuring the driver. Damn I'm glad I didn't do that even though I was dumb enough not to get the insurance.
