can dealers refuse transmission swaps??

ah the infamous transmission problem has hit me once again. i had it swapped for the first time in May of this year but it is starting to go again so I took it back to the dealer but this time made the mistake of telling them that i drive it in SS alot and they are not willing to goodwill the transmission again so i plan on taking it to another dealer near my house. my question is, can dealers refuse the goodwill transmission service due to performance aftermarket parts? can their argument be that the transmission can only handle the power it was designed for? my 2g TL has just about all the performance mods out there (exhaust, headers, under drive crank pulley, spacers, CAI)

Well when you get the tranny it comes with a 12k/12 month warranty. If the dealer just replaced it in May it should still be under warranty unless you have already driven 12k.

they're telling me because i was driving alot in sport shift mode that it burned the tranny and thus my fault

isnt the ss mode there to be used? i dont understand why they would use that as an excuse

No they can't refuse to swap because you used SS mode. All SS mode does is tell the trans went to shift.

As far as the aftermarket parts: they have to prove that your parts caused the transmission to fail.

they said that the SS mode is only supposed to be used sparingly.. i dont know about you guys but i hate being picked on because i'm young.. they just automatically assume i'm gullible

SS mode is just you telling the computer when to shift instead of the ECU using it's own pre-mapped points. If you told them you go hauling ass in SS and redline every day and hit VTEC all the time, that's a different story. SS mode was put there by the manufacturer and should have to effect on your warranty (assuming you still fall under the 12mo/12K mi window).

i dont haul ass/vtec everyday but i do admit i drive aggressively (3 or 3.5 thousand rpm accels).. but im guessing they just assume i floor it every chance i get just because i have performance mods i absolutely am under the warranty. i'm just gonna try a different dealer

ss mode is their to be used, and unless any of the aftermarket parts your put on void the warranty then they should replace it for you, seeing that your still in the 12/12 range

what kind of parts would void the warranty? from what i know, there is a law preventing dealers from voiding warrantys because of aftermarket parts

They have to PROVE the modification CAUSED the problem
Since other dealers have warranty covered supercharged cars- your things are minor

Are you a covered VIN for the 7 year9 month/114.5 km miles trans warranty extension
they are now counting the 5% odometer error! yeah!!

If covered VIN you can get 5 warranty transmission as long as its in the ranges.
If not covered VIN late 03 and they GOODWILLED the first one- they ar eunder no obligation to replace it again-

Driving in SS mode certainly does add stree to the 2nd and 3 rd gear clutchpacks- the weak point of the car. Since you spend most of your tine in those gears- 20 to 100 mph,,,,
BUT its not in the Owner Book saying use sparingly~~~ It DOES give MAX upshift and downshift speeds- which- lets guess our young member does utilize fully and often-
adds wear to the weak parts

Depending on the VIN I would ask another dealer- this time keeping mouth shut about anything past- my trans is acting funny- I dont know whats wrong
If another dealer diagnosis failed unit- they can negotiate with acura for partial coverage

Tom, did you see where he already got it replaced and has a 12 month / 12K mile warranty on it?

no I am losing more vision every day and dont like wearing glasses at the computer
I can wear them when I drive or when I am online- which would you prefer?

On my 01- when the trans was replaced, I was told the unit itself had 12/10 on it, and in addittion to that, the car still carried the 7+9/109 now 114.5 trans warranty

In a discussion with servicewriter recently about 03 out of vin and canadian cars- the requirements for trans fluid service,
and
those cars getting GOODWILL the first time on a trans replacement- they have used up their goodwill with acura after 12/12
There is a new thing with acura selling a 3/36 to those goodwill cars for $300
thats a deal IMO
So does it make sense that I try to get all the parts of the story in one sitting?

ok I put my glasses on and see the OP drives an 01- so the term GOODWILL does not even apply to his car
It was a standard trans extended warranty replacement- no more- no less
There is no reason for the dealer to deny coverage on mods, besides the belief that in 6 months you blew up a trans racing.
If you had gone in a few times already- complaining of bad shifting- and they test drove and could not find- normally when it does quit in that case its a no hassle replacement- Sorry Sir- humans assemble these things...can we give you a ride home?

BUT
When you come in and make statements about use of SS, what they ~hear~ is
I abuse this car and possibly use it in racing competion- santioned or not, maybe the day before.....
and thru no fault of the rebuilt $4000 transmission- its dead now~
Surprise~! They can deny coverage if abuse is suspected- read the fine print in the manual

As I said before- go to a dealer in the next town and state whatever actual symptoms it has- revs while shifting in normal D5, takes 5 seconds to engage D from N etc.
Do not make stuff up- give the tech info they can use
Maybe its been funny but you were not sure----? maybe just your imagination???
- then last week....it started acting up.

Correct me if I am wrong but since the OPs car is an 01 his car doesnt get the 114k extention just the 109k?

Also to the OP when did you get your tranny replaced (excate date) how many miles where on it than and how many now. Read what it said on your recpeit about the tranny. The dealer cant void the warranty for using SS. Its put there to be used.

i believe it was may 20th of 2008. so regardless of the extension on the transmission and year of my car, i should be covered for a 12 month 12k mile warranty on the transmission correct?

Yes if your first tranny was replaced under warranty and they give you a 12k/12 month extention. SS is there to be used and they cant void your warranty for that. Do you have another dealer you could go to?

yea i just have to make time to go. so after they told me SS was bad i stopped using it and thats when i could tell the tranny was going.. so i recently started using it again and IMO it stopped jerking like crazy which leads me to believe i have a couple weeks before i have to take it in

If the trans was good willed the first time there isnt always a warranty.

Thats the issue here kris- OP said they goodwilled it- but he is an 01, unless it was over mileage and they goodwilled it
We need FACTS!

As for the odo eroor extension thing- I admit to not knowing the VIN run of the court decision, just going off what member servicewriter- who works at an acura dealer said

i can't find the invoice right now but my car is 104k miles right now and the service was done early this year in May, so most likely at the time, it was around 102k. the car is a 2001 tl-p

wow man what DID you really do to the trans- drop it from 5th to 2nd several times in a row?
The owner manual has good info on SS operation and its limits and speeds,
read that while your car is in another shop getting fixed!

Was the originally tranny replaced under warranty or as a goodwill? If they replaced it under warranty they HAVE to replace the new one that failed in under 12k/12months.

Its 7 years or 9 months. Oringally it was just 7 years but after a class action lawsuit they put it up to 7 years 9 months. So instead of expiring on 12/2007 it experises on 6/2008. Which means if it was replaced in may it was replaced under warranty. Check your receipt it should say something about a new warranty on it when you got it replaced.

Take your receipt to another dealer and dont mention how you drove it. They should cover you.

theyre trying not to lose money. if the waranty is up you need to pay but otherwise you should fight it. look it up i bet they HAVE to replace it tell us if you get it changed or not

they dont lose money!!! they just dont make as much on warranty from acura as customer paying retail-

but when was the last time a ziner went in a paid $4000 retail replacement- they get the trans rebuilt at anothor shop for 2500 instead
and the time is based on the date of first service- day the car sold new- acura can tell you when and if you are part of the odometer cars too
