Bad news inside....RIP TL
Earlier tonight I was going to a local store to pick up some items when all of a sudden I see a vehicle burst out in front of me....I slammed on the brakes but that wasn't enough, it has rained earlier tonight, and the roads were wet... it was a T-bone accident
I knew there was a stop sign at the intersection for the other vehicle....but there wasn't a stop sign on the main road that I was on...
Just completed a navi conversion for it that I have yet to install!! ugh

I'll post pics of the intersection, including the bush, and it better not be gone in the morning, however the other passenger took a pic with their camera phone..
As for a car, I don't know what I should do at this point??
I don't believe any tickets were issued, I feel that strictly the city should take fault for this unsafe intersection!

So sorry to hear this bad news. Thank goodness no one was hurt and it's just damaged cars....and pride.
As for liability...I'm assuming it was your stop sign that was covered by the bush. I think you have a good case to sue the City for lack of maintenance and I'm sure your insurance company will sort that out. Just hope that they don't find you at fault and have a third party liability clause in the policy.

(they are not called accidents anymore, that implies something happened without abilty to prevent, if the other driver was going right speed and paying attention...)
The other driver failed to yield by stopping at a stop sign- obscured or not is up to them to document and their insurance can go after the city-- that driver should be ticketed-
Tickets dont always happen on the scene- cops make a diagram and figure it out at the station in the dry
Immedialty Call your insurance agent- Give no statements to the other insurance without consulting your agent
Give the other persons insurance info to your agent/company claims dept and its their job to get your car fixed, or replaced/totalled payout,
They collect from the other company. This is what you pay for - even if you only have liabilty, which covers damage you do to other property or people- your insured and its their job to collect from the other place for you.
If you have fuller coverage it should include rental car during accident repairs
So first thing to do today is photo document all the damage to your car, PRINT THE PICS OUT ON PAPER for the insurance company (they dont do disc or attached pics)
If you have before pics- include them as proof of cars condition
List all the aftermarket parts or any service you have recently done-with receipts!
it adds to the value of the car in figuring payout or repairs
Things like rims- manifolds-headers-exhaust, think- non removeable parts or damaged parts that cost more than stock to replace like rims and tires
Be glad no major injuries and the safety features did their job- the car should fold and crumple around the driver cage- leaving you intact and the car headed to the beer can factory

Its called situational awareness, if you know an intersection and its dangers- always expect someone to blow thru the stop sign and drive defensive- CYA!!
On my way out of the house, have to turn left onto a long straight 35mph steet-average speed 45, with a sudden and well hidden stop sign after 1 mile of none-
it does have the solid white line going across the lane STOP written on the ground but...
Something like 6 out of 10 cars do a rolling stop or split second almost stop, with 3 not stop and not doing a head turn-look- to either side! just rolled thru at 25 or more, .kids cross there with no crosswalk...
I call that a known hazard and treat it as such~

I tood the OP to mean that he T-boned the other guy who got in front of him in a hurry (faster than he could have had he legally stopped at the sign).

x2. you have the right of way and other driver failed the stop sign; whether he wants to claim with the city or not it is up to him. It is easily to find out whether he didn't see the stop sign or not, or purposely ignored the sign.

And yes there was a police report, and it seems that the other driver that failed to see the stop sign did receive a failure to stop ticket! However I didn't receive anything due to the fact that I had the right away!
Posting pics of the damage in a few mins, I had to get some belongings out of the car, and snapped one pic of the front end damage...
Overall I felt very safe throughout the collision, first time experiencing airbags in a collision, it was insane!
By the way, I was the one doing the boning!!! I was the | in the T, and the girl that ran through the intersection was the one who was horizontal....

well if the police report says failure to stop on their part, youre good to go. Good luck finding something else-at least youre not getting stuck with paying for it yourself or getting an insurance hike!
My car looked exactly like yours!!! I'm also glad that everyone was ok, I'm sorta sore, and experiencing tightness in my lower back and pain in my left foot, but of course nothing lifethreatening!
get that checked out, if you find out later it might be hard to get paid for, if you have something wrong and get medical bills.

man, sorry for your loss bro. It sucks that it has to be an ABP too. I dont see to many ABPs around anymore. just be glad you're okay, and your car will be taken care of through someone else's fault. There is also a possibility that it might not be a total loss either. My friend got t-boned on his CL, pretty badly too and they repaired it which is stupid, but yea, theres a possibility that it isnt. I remember the first time i had airbags deployed on me. It was on my honda prelude. never want to experience that again. The airbag left a fat rash under my chin thats like 2 inches long. shit was bleeding like a mofo on thanksgiving day too!
