rebuilt or new transmissions?

I am just wondering if Honda/Acura has committed to replacing with New or rebuilt transmissions. Does the consumer have any rights in this situation? I was just told today that my 2001 type cl/s is having the tranny replaced with a rebuilt. This doesn't set well with me, especially after reading the stories on here. If anyone has any info to share I would appreciate it.

I have had the replacement transmission for about 2 months now and have no problems, but I do notice it shifting a lot harder than it did before, particularly on the 2-3 shift when under moderate power.
A Honda mechanic that I spoke to said that it is much better to have solid shifts, especially with the high HP engines like the Type S.
I am still "on the fence" whether I keep the car or not. I think that Acura integrity is non existent. Anyone can have a manufacturing problem... but not fixing it for 5 model years is something else again.
