Xephyr Intakes, what I am doing about this......

Well first off I am coming public with my utter dissapointment in Xephyr Inc. Chris I wish you the best in whatever you do but unfortunately I am not holding a candle out for you and your products anymore. Soopa has informed me that you are checking this forum and seeing the updates yet you decide to not let us in on what's up with your company.

What worries me most is that I now have a product on my car that is virtually unsupported. Am I worried? HELL YEAH. If for some odd reason your intake fucks up my car I don't even have someone to call, yet sue in court. Lemme do the math real quick:

30K car with support and warranty
$200 product with no support or warranty

The car wins the arguement and your CAI will only remain on until:

A. Comptech releases their ICE BOX which is warrantied and approved by Honda of America.

B. I buy an AEM which may not be as good at least I have a big label to account for.

I am very very dissapointed with this whole clusterfuck of events. I cannot speak for your other supporters but you lost one of your biggest supporters in NJ. If you needed help I could have helped you, any of us would to keep your business in good shape.

I guess you not showing at the Park Ave Acura meet was the final straw. Me and a few others looking like idiots when people ask us where you are. If your not going to support your product neither am I.

P.S. I am well aware that if a problem was to occur I could simply sue you personally and still Xephyr up to five years from the date of incident, and having an LLC or 'limited liability company' does not shelter you from multiple lawsuits or lawsuits due to defect in manufacturing. Guess it pays to schmooze with the top ten lawfirms in the States of NY and NJ.

2 weeks ago I went through Xephyr's website to order the CAI, and paypal choked and I decided to come back and do it. Reading all this crap over the last two weeks makes me glad that PayPal sucks!!

I just placed my order for the AEM CAI from Tim.

ps - I prolly shoulda waited for the Ice Box huh?

Why is it everyone says AEM isnt as good?

Thats bullshit. Your just going on the heresay of Xephyr.

There is absolutely no reason the AEM intake wouldnt be as good... if not better then Xephyrs.

It has thicker sidewalls... same inner diamater of tubing... longer length... and the same filter.

You cant honestly believe Xephyr's intake is any better. Gimme a break.

Agreed Soopa, the only difference was price and for the extra money from AEM at least your getting a warranty.

AEM is KNOWN for the best Intake. This is what I said from day 1. why save a couple dollars and go w/ a brand that is 1. unsupportive, 2. 0 for customer service 3. half done intake 4. ugly sticker?

Go w/ known names and known dealers like AEM, Injen and other companines that's been around for quite sometime.

Just all My opion.

What ever happened to that one dude that was trying to get his $$$$$$ back from chris????

I was thinking of getting a xypher intake, but knew, just KNEW this guy was gonna flake (and this was well over 4 months ago when he FIRST started)

Chris, if you can hear me, You need to give it up totally and return these guys money!!!!

I know If I released a mod and had anyone even remotly intrested, I'd be bugging them to death until they bought my product.

Uhhh, maybe he took the $$$$$$ and ran to vegas!

This guy needs to go down on the BLacklist scamers list for internet fraud!!!

I've been trying to keep my mouth shut about this subject. But I'm tired of vendors who do not ship. Especially vendors who take your money and do nothing. The groupbuy That being said, I'm glad that I held off for the AEM. Sure X came out with one first, but I saw one of his intakes at Houston meet and I've got to say that it looks home-made, to put it mildly. I leave it thta to not offend the members with them.

Most of you know how I feel, and what I and some others have to show for dealing with Xephyr. NOTHING!

1) He promised and posted a shipment date. It never happened.
2) He was lambasted here, mostly by me, for the lack of shipment.
3)He came back once, and laid into me for, for.... Well I guess it was because I refused to be lied to, cheated and taken. And demanded he contact us regarding the failed shipment.
4) We received tracking numbers for the shipments.
5) After the delivery date arrived, I checked the tracking number. "manifest pickup" but no package had ever left his place. According to UPS anyone can do this. It just generates a tracking number. But no pickup until expressly requested by Xephyr. (I contend that this was a stall tactic)
6) I emailed, phoned, and posted here, canceling my order.
7) After a while a refund showed up in my paypal account. It needed 4 days to clear.
8)After 4 days had past I checked the account to find the refund cancelled, "payment reversed" that's right cancelled.

There has been no response from him, and myself and a few other are out $215. With no indication of when or if it will ever be refunded. So basically, at this point he his a thief, and in direct violation of laws regarding fraud.

I continue to try to contact him.

I've filed with the BBB.

And paypal has it under investigation.

I am filing a complaint with the New Jersey Attorney General.

I am in contact with an internet fraud attorney.

I am looking into the feasibility of court action in Camden County.

There are others that he owes money to as well.

Other options are NOT out of the question.

This is a sorry state of affairs, but if any products have been shipped via US Mail, it gets much more serious and some issues may run up into mail fraud.

BTW -- while I'm generally happy with the AEM, I am not happy about the treatment some of our members have gotten regarding the early one. They took care of me, but they sure didn't do right by Gold! They were supposed to send me an e-mail with contact info and some info to post here on how to tell if a unit was an early one (needing some hardware) or a later one. Finally, they should have just given all of us early unit guys, new pipes -- how much would that have cost?

I hate to see this go soo bad but it is what it is, we did not cause this to happen, he did. If I was owed money like this I would be a liar if I said I would not be going through the same channels.

I would think many were embarrassed by his "no show" at the meet over the weekend.

Why wouldn't he show? You would think that he would want to save face with his supporters. The ones who have fought so vigorously for him.

Or maybe there was anther reason he couldn't show his face at Park Avenue Acura.....Hmmmmm

The mob/group mass effect is like momentum -- it keeps picking up speed until someone puts on the brakes.

The question is -- will Xepher put the brakes on all of this, and allow for a "semi-graceful" exit?

Well, the longer he keeps my money, the longer I spend time in the BMW & Acura forums warning people.

Oh BTW. Has anyone noticed his website has been update to include PT Cruiser. I have to go to those forums now as well. I wonder when he found time to do that. I guess our money is being used for R&D huh?

Time to close this.

We know hes not going to respond to this.

Smart people will swallow the extra cash and go with AEM... or shit... even Injen if their bargain shopping.

Xephyr is dead to this forum. Unless he owes you money no more mention.
