I don't know how to fix it but my advise is never let the dealer be a bigger asshole than you. If the brake light rattles they need to fix it - no question. This is a new car under warranty - if something is wrong it gets fixed - period.

I made the Honda dealer take the cloth off my two front seats in my Civic and replace the springs because they squeaked in the wintertime. They weren't happy but I made them do it.

pull out your back seats so you can take out the rear deck trim. unbolt the 3rd brake light, i think the nuts are on the bottom in the trunk. remove the brake light.

then i took a piece of black neoprene foam, about 1'x1' and put it down where the brake light was (so when you look in the hole in the deck trim it looks pitch black). you can't even tell it's gone.

saves a few ounces of weight too.

Have someone ride back there and find otu exactly where it rattles - if it's the housing hitting the glass, etc. - and see if you can put some padding there.

Swing by your dealer and stroll through the lot .Look for brand new cars that are still wrapped up in plastic .Most of them will have small grey stick on rubber like bumpers on the front and rear. These things are terrific for cutting up into small noise eliminators .When you go for the third brake light rattle do this :With your grey foam block in hand cut two small pieces about an inch on a side and about a quarter inch thick .Now fold one piece over a medium flatblade screwdriver and shove it on one side of the 3 rd brake light where it meets the lower edge of the rear window .Do the same on the other side ,Ths is usually all it takes to get rid of the noise .Plus if you make the foam blocks the right size they are invisible unless you go looking for them .
There is another source of noise in the rear but it has nothing to do with the 3rd brake light .Have a helper drive you around while you are back there .Listen for a creaking coming especially from the upper edge of the rear window. If it is in fact creaking (quite a few cars do this ) you may need to slighty and i do mean slightly and carefully bend the actual sheet metal the rear window is glued to .To do this you need to just pull the headliner down a bit .If you look up in there you will see where the various layers of sheet metal for the roof are spotwelded together .Remembering where you heard the noise from grab that section with a pair of pliers or vise grips and slightly (AND VERY CAREFULLY) bend the sheet metal down .Redrive the car ,usually a few slight bends here and there and the noises are gone forever .

OK. Sorry for the delay. THe reason you hear that rattle is because the back light is banging on the rear window and elsewhere cos it's not installed real tight. So here is what I did:

There are rubber sticky thingies that are sold at Home Depot that are used to put under chairs, tables, etc. Mine was about 1/4 inch long, it was somewhat round (cylindrical almost) and it was about 1/4 inch in diameter. It also had a sticky side. I put that between the plastic frame of the rear light and the rear windshield but deep, where it cant be seen. Rattle gone.

Actually, now that I am thinking about it, there was no sticky side on mine...I used superglue. Did it like 2.5 years ago, sorry.

I don't know if this is the same "rattle" or not, but mine sounds more like a cricket chirping or something.. it happens whenever I hit cracks in the road, or uneven road surfaces... It's definitely coming from the back seat area... the dealer had my car for 3 days and NONE of the guys there could find it, they tried EVERYTHING... it's really maddening... I don't think it is the 3rd brake light, but I'll try that...

Home Depot also sells foam door seals that do have a glue side. My little rattle, my first, is the seat-belt thing-a-ma-jig at my left ear.

I'm sure plain old door insulation stripping would work well too...cut into tiny pieces of course.

Listen to Jens...the third brake light is very easy to fix...plus the bumper guards are made of some sticky ass shit. Anyway as far as the spot-welds...I don't think many members will have this problem...considering that every car that I have done w/ this...can only be heard w/ no radio on and complete silence on a bumpy road...I usually insert a small flathead screwdriver inbetween to two pieces of sheetmetal at the weld and slightly turn until the sheets bend evere so lightly....

There is a thread here or in the FAQ's about stuffing some material between the rear deck and the window on either side of the 3rd light. This stopped mine completely. Wife went to a fabric store a got me a couple of 3x8" scraps of black (my interior is parchment/tan). I rolled them up and stuffed them down and presto, no more rear deck rattle.
