What Happens if......?
Guys, i was jsut thinking of something, and i was wondering what you guys think.
What would happen as far as insurance is concerned if you are driving your CL-S on the highway and the tranny goes and does its typical failure of downshifting to 2nd gear at 80 mph and you cause an accident because of that. do you have to pay for damages to your car and/or other vehicles?? are you liable for that given the fact that Honda/Acura has admitted to this happening and that it IS a factory defect?? i mean, i dont know about you guys, but my insurance is high as hell (200 per month) and my collision deductable is 1000 and i dont need to have to fork over 1000 bucks toward collision coverage and see an insurance hike because my tranny died. i was wondering what you guys think of this, as it seems its only a matter of time before this happens to someone here.

An accident is an accident... so you would have to go through the same channels regardless of what caused the accident, meaning paying deductables, etc.. Once the accident was determined to be the fault of the tranny, then either you or the insurance company would sue Acura to try to recooperate the any money you lost from deductables, other suits, etc.
That would be my guess.....

from my experience w/ accidents caused by extraneous phenomenon, what juniorbean says is true. I hit a sewer cover that was protruding out of the road due to construction. Went to my insurance company for a "consultation" of what to do. They told me it was best that I went through them. Paid my $1000 deductible and they paid the other $2500 for my engine and tranny. No lawsuit ever came out of it...sucks cause it was completely not my fault and I had to pay $1000 for no reason.

Damn,
I wish my insurance was that cheap. I fork over 540 a month to State Farm. I hate NJ for Insurance. I'm getting screwed and they don't even have the courtesy of a reach around.

How should this work? Also, if I switch insurance companies, would the new one necessarily know about the previous accident? I wasn't ticketed for anything, and It happened in a different state than I've ever lived.
BTW, I'm 22/m in FL, no tickets ever, above mentioned accident is the only one I've been in. My insurance is $260/mo on a 1994 Camry, and would go up above $340/mo if I got a new CL-S. About $1000 more per year just to insure the new car.

I'd drive a beat up POS before I were to fork over $6500/year to drive a CLS. That's just insane!!!

In my previous car, I was in 2 accidents, neither were my fault.
First accident: rear-ended on the highway due to stopped traffic and a burning truck partially obscuring visibility. The other guy's insurance wanted to low-ball me (to the tune of about 20% of the actual cost to repair), so I went through my insurance. I paid the deductable and everything was handled to my satisfaction. 6 months later, I get a check from State Farm (my insurance) for my deductable. Net out-of-pocket: $0. Rates increased: $0
Second accident: about 3 years later, a woman pulled out in front of me, turning from a cross street across my lane and into the opposite direction of traffic. She never looked my way. She received a traffic ticket and another for having an expired insurance card (but valid insurance). In this case, the woman had State Farm as well. Her claim team called me, admitted guilt and notified me my deductible was waived. My insurance picked up the rental car during the repair. Net out-of-pocket: $0. Rates increased: $0
So your rates might not change at all if you can show it was the tranny and not your own bad driving.
Naa, I had my 99 Maxima, got in an accident. Totalled 2 cars, and mine, and they had to cut me and my friends out of the car. Pay for Property Damages. Yadda Yadda Yadda. Hostpital Bills for Friends and Me.
