Question for the guys in Florida regarding a speeding ticket.

I need help here. I made a road trip to FL last weekend and got a speeding ticket for 86mph in 70mph zone on I-10. I was going with the flow. When my car was hit with instanst-on, I couldn't slow down because there was a car riding my end. The cop was pretty cool. He asked me stuff about my car stereo stuff before he even told me why he stopped me. I think he would have let me go if his boss wasnt behind him. Anyway, I dont know if he did it on purpose or not but he wrote the ticket wrong. In the ticket, he stated my race was "W" which I am obviously not. Also, he wrote the car maker was "Inc" which I have no clue what it is.
Here is my question. Would I stand any chance in fighting the ticket? If yes, how? He told me I could take on-line defensive driving course but I would like to see if I have any chance first. Thanks for reading and sharing your opinions.

i believe so

if the cops dont cite the ticket correct i believe they have to let you go!

this might actually give you some leverage you might want to contact a traffic attorney in florida and see if you can get the ticket dismissed!

The only problem is that if you take the ticket to court...you may have to come back to Florida & fight it. Is it actually worth the trip again?


Depending on your record they may write the ticket off, but as long as they have the important things on the ticket(DL #, tag, name, address) I dont think they will waive it for having the wrong race/car make. I'm not 100% sure though

You can fight it and not have to go by hiring a FL attorney. However it will be tough to determine who's gonna fight and who's gonna just get paid. I used one once when I got a ticket about an hour and a half away from my house. I paid way more than I should have. I never even spoke to the lawyer, just his bitch secretary.

From experience. You can plead guilty on the ticket & send in your fine. Chances are FL will not report the ticket to Texas. They didn't report mine to NY. If you fight it, there should be a court address to go to, & a date. You can show up, & plead no contest, & the judge should let you off with a small fine, if your record is good. Or you can plead not guilty & then the judge will setup another court date which will be your trial. That's when the cop will show up(maybe not) & you bring your evidence if any. Hiring a lawer for like $100 will save you the trouble of showing up in either court hearing. I'd save all the headachs & just mail the fine in.

I'd recommend sending it to a lawyer, the Ticket Clinic always works for me down here in South Florida, and for just about everyone I know. Maybe you can try giving them a call, (800) CITATION. They usually charge about $70 per ticket and you don't have to come down for court.

Here's an option. There is a place on Yamato Rd. in Boca Raton, FL I believe that's called the "Ticket Justice Center" and is run by a bunch of lawyers. I think you pay $80.00 and send them in the ticket...bingo...squashed with no points off your license or insurance. I did it for my wife a number of years ago when she got a speeding ticket. I also believe that if the cop screwed up your plate number on the ticket, don't even bother to respond, otherwise check this place out. (561) 988-8402. Enjoy. We may not no how to vote, but we know how to get out of getting screwed for traffic tickets. If they can't help you, ask them for someone in the county you got the ticket in.

i wouldnt bother with it. just pay the fine. usually points dont transfer to your driving record if the states dont border eachother.

the race and the car model most likely wont hold up in court with the judge because you can still be clearly identified and so can the car.

I don't lurk here enough to know what race you are Silver, but I know that up until 1999, the NCIC (National Criminal Information Center) computer system that every police department in the country is hooked into only recognized five race categories: (A) Asian or Pacific Islander, (B) Black, (I) American Indian or Alaskan, (U) Unknown, and (W) White. That's it. I can't speak for FL since I live in MA, but if FL designed their citations prior to 1999 and used NCIC race codes when setting up their citation system, then those are the only choices you get. So if you are hispanic or latino, etc, NCIC says to list you as white. That's how it is in MA (or was up to 2001). Regardless, like 1genCL said, as long as the officer can identify you in court then the point is moot.

Also, in MA (since 2001) they redesigned the citations to help find out if racial profiling was going on. Officers are instructed to record on the citation the race of the operator as *they* perceive it, *not* as it actually is. Meaning, if the officer stops a light-skinned black male and perceives the operator to be white, he records W in the race field. Even if the operator really is black, it doesn't matter for purposes of identification--it only matters what the officer perceived his race to be at the time of the stop.

Oh and another thing about FL cops...I have a few friends that are and my sister is dating a state trooper...(no I can't help you out) but a thing they like to do is to use that "boss" is in the car behind them shit...They actually use that more then not if your someone that is in the military or a female...You know, the ones that you really don't want to give a ticket to but you need to make your quota kind of thing...I got that done to me twice in FL and both times my buddies confronted them and they admitted they were lieing...

One of them even admitted he was getting in trouble for not making his so called "quota" so that's why he gave me mine...I was going 66 in a 55 zone (the normal speed limit is 65 but it drops for a 2 mile segment to 55 where I got busted)...It was on September 11th 2002 and I gave him my military ID and still got a damn ticket...

I live in FL and I am an attorney. Hate to tell you, but the race and car mean nothing. Either pay the ticket, hire a lawyer (no I do not do traffic tickets), or take traffic school which can be done on line. However, I do not know what the deal is with the traffic school if you are from out of state. Honestly, you are unlikely to have the points reported to TX and may be better of just paying it and forgetting about it. Hope this helps. Sorry 'bout the ticket.

Well, thanks all of you for the comments. I have decided to take the online traffice course. Regarding the "boss" comment, the cop was honest. It was a speed trap. 2 cop cars parked on the median facing opposite directions behind the trees. They can see you but you cannot see them. Anyway, after I stopped for about 2 min, the other cop pulled up in a Camero (prolly Z28).
It sucks that I got a ticket but it's ok in a way since the guy who gave me the ticket was a nice car-guy. He sincerely apologized for giving me the ticket which made me really feel like he was forced to give out the ticket.
