Painful Day finally over...

:angryfire Well everything went fine today except the time I left work... Things just started going wrong.. Had to drop of a parcel took 30 mins at Fed Ex... Anyways on the drive home about to take my exit and everyone slams their brakes, I was WTF?? Well just when I was about to change lanes I see why they were braking... A long metallic peice with wood was in the middle of the road.... The car ahead of me hits it, and I have no choice but 2 go over it as well since there is no shoulder (road work) and there were cars to my rear and right side.. while of the left side had the concrete wall. Pulled my car over to inspect the damage, and saw other cars pulling over as well.... Well slashed both my driver side front and rear tires.... bent both the rims.. :angryfire Driver Side tire had 3 cuts in it while the rear had four slashes.... In all 7 cars had front and rear tires slashed.... Called OPP (Ontario Provincial Polce) to have the metallic object removed before someone seriously gets hurt..... Came home and found a leak in my laundry room which was sipping to my basement... It just been a long day had to a little....

Well I could inform my insurance company since I notified OPP what had happened... only question I have is would my premium go up cuz of the claim?? Secondly the insurance company can take the claim against the Construction company since it was there object left int he middle of the road which caused the damages....

man sorry to hear that. don't know how the insurance would work, but hopefully it will work in your favor. And on saturday, there was this box on the freeway and the car on my right which was 2-3 car lengths ahead of me hits it, so i thought i would be ok, turns out the box then came into my direction, had no choice but to hit it, fortunately no damage was done since it was an empty box, but still its nothing compared to what happened to you.

If the contruction company claims that it was their pipe or metal peice then they are liable and should pay for your damages. If not, sue them, 200 dollar court filing fee sure beats an extra 50 dollar per month added to your insurance premium.

Once you threaten a law suit they should pay up anyways. Make sure u get pictures of everything before you fix it. Get pictures of the road and the pipe if its still there.

I took pictures with my digital camera when it all happened... Couldn't take pics of the metallic object since road management removed the object when OPP called it in... I have the names and numbers of the other cars involved.

I am a paralegal at a law firm. I dont work in canada, but there is nothing stating that you have to go through your insurance agency to receive monetary consideration for damages cause by another's company/employers. Tell them exactly what you told us and let them know you will go through your insurance company but you expect OPP to pay any increases in your insurance premium related to this issue for the next 5 years, i dont think they will want or agree to do that so.... Just go get written estimates and quotes for new tires/wheels, send it to them with a certified letter and demand payment.

Of they do not cooperate, you may want to get a law suit going with all the other people that had their cars damaged by the object. I am sure they will all want to avoid going through their insurance agency also. They put the object in the road, why should you have to pay for the next 5 years for it?

That freaking sucks. I felt bad when I dished a rim on a pothole a couple weeks ago, I can't imagine how pissed you are. Hope you get it resolved.

Yeah I can sorta relate to you, I had a crappy experience like this back in January. The water company had dug a hole right in the middle of a two lane road (one lane in each direction). Apparently the cover flipped off somewhere, and this huge ditch which spanned half of the lane was exposed. My girl was driving in her little slammed 95 Civic and it was too late by the time she spotted the ditch, so she ran over it and bent one of her wheels and damaged that tire. Well to make a long story short, we were lucky that she was able to get the insurance claim information from the utility company and she filed a claim and got reimbursed for a new wheel and a couple tires. She didn't have to go through her insurance company.

Hopefully it'll be a similar resolution for you. Good luck getting it all sorted out.

I see that you live in Ontario (and so do I), and what happened would not be considered your fault. You may have to pay a deductible, but your insurance will not increase from such a claim (unless you've done many of them in the past). Call them up and ask them anyways, then decide weather or not to put the claim through.

In the US, things are different... in Canada, you talk to the insurance company in most cases, and your case doesn't sound like an exception!

Good luck!
