Dude, I hope for your sake you don't ever do that again.

Look at it this way, If I got my credit card bill and someone else had used it to charge something, I would kill the charge and I assume the company with the sale would investigate (which wouldn't take long). And I assume in the eyes of the law, that it doesn't matter how you were able to get someone else's credit card infomation: If you knowingly make a charge on someone else's credit card, you're at fault. And I doubt the penalty will change if it is $20 or $2000. It's still fraud.

Anyway, soapbox off - but I didn't want this thread to end with a 'Yeah, great idea!' note at it.

So I’m guessing if you happened to come across a car with the keys forgotten in the ignition, it would be OK to take it for a spin because “it was just there”.

Getting something you didn't order is one issue -- (at least in the old days, if you wanted to, you could keep it. There were a number of people that used the technique of sending unwanted "items" or "merchandise" to people as a way to "help" business.

OTOH -- receiving a package or messing with the postal system with criminial intent is MAIL FRAUD.

Amir, usually I'm with you. But, in this case you're mistaken. If you physically stole something, it only being $20.00 is at most Petit Theft. However, in his case, Credit Card Fraud and Mail Fraud are federal offenses. (you knowingly used credit information (however gained) that wasn't yours is credit fraud, that you had it sent to you via mail is the mail fraud). Not to mention the transport across state lines, violating both states, state laws. It ain't good. If they guy challenges (it it was AMEX they are gonna slam you for sure), you left an electronic trail a mile-wide. It sometimes takes a couple of months to get the require warrants to search electronic records and the like. Basically, it was stupid, and criminal thing to do. Note: I'm not calling the guy stupid, but his action was.

If anyone comes and asks questions, all you have to say is that you thought it was your information (credit card number, etc.)

I don't think it will be worth any company's money to pursue fraud charges in court over $20. Just to get a trial is more expensive than that. And what about lawyer fees?

I don't think you have anything to worry about. IF you are confronted, just play dumb. It is amazing what you can get away with under 'ignorance.'

edit - {I'm not saying this is the 'right' thing to do. I wouldn't recommend making a habit out of this.}

Whoever's information was there placed an order from that website in the first place. So he/she probably overlooked the charge on the bill and didn't realize it appeared twice. Just my theory. Good Luck and Good Kill
