Had a Car Accident Today

Was traveling in the far right lane and a guy from the center lane just pulled into my lane.

I tried to go as far right as possible, and went up the curb, but he still continued to pull into my lane. How can you miss a car with HID's. ? So we collided since I had no where else to go. Left Side of the Car is rippled the body. Front Bumper Broken Underneath and RIMS messed up from the curb.

He tried to say it was my fault. but i wouldn't speak to him until the cop got there. But since no witness the accident is written up as a He Said She Said senario. Just hope my insurance will find me not a fault so my rates don't go up.

Damn man, that freakin sucks. I hate morons who can't drive worth shit, and then try to blame it on you for their stupidity!

Perhaps you should hire a lawyer.

I was actually on the way to the lawfirm i do network consulting for. But I'll wait to see how the report is written and how insurance deems who was at fault or if it was a No Fault NJ Crap

What kind of story could she make up to explain the damage to your front corner and her rear corner? The cop must have not be trained in accident re-construction. That really sucks! Atleast your not hurt.

no kidding - sounds like a clear case of unsafe lane change.

did you hit the horn when she started drifting your way? (I know sometimes you just don't get a chance to, I was just wondering...)

Dang, that sucks. I hope there isn't much damage underneath the sheetmetal.

Do what I do next time. Just lay on the horn, stand your ground, and be ready to jerk the steering wheel into their direction. It's far safer for you to put them into a spin than try to move to the right -- there could be other cars there, or road debris, signs, whatever. Don't risk your life. Just do the PIT maneuver.

I've never had to do this, but I've come close several times. And believe me. I will not risk my life or anybody else's in my car to save some idiot's car and his/her life. I WILL put them into a spin. And yes, I will sleep like a baby that night knowing that another idiot driver is off the road, at least for a little while.

Tip...
Keep a disposal camara in the car to take pics in case this happens. That way you can take pics of everything.

Sucks about the car. I almost had the same thing happen to me this weekend when I was on the turnpike in traffic.

One thing I hope you did was take lots of photos. I am a Real Estate Appraiser and carry alot of tape measures. Measure as well.

I had an accident where this bish clipped me and slid uphill. I measured it with the cop and it was 80 feet. I wrote up my own accident report to give to my Insurance compant and included pictures as well as diagram/measurements. The Insurance company loved it and gave them a clear picture of what happened.

Sorry about your accident. I know how sucky it is.

This looks like a clear case. Not sure about NJ...but here in CA, it would be the person who's changing lanes be @ fault. Now..if he could somehow manipulate the scenario where YOU were changing to his lane, then it would be another story.

If he can convince the insurance and highway patrol of that, then he's an artist.

What I don't understand is why didn't you apply defensive driving techniques and slam on the brakes instead? He must of been cutting you off pretty fast.

"should" be a no brainer, if you where in the far right lane and he was in swapping left for right lane. He will be found at fault as you where not the one swapping lanes, he probably just could be not bothered to look, assumed it was ok and then hit you.

I'd say you have a good case to win, hes at fault, but get a lawyer it be a smart chioce.but get a lawyer it be a smart chioce.

Glad your okay, hopefully the fucker in the truck learns his lesson, but if he hit you then you have proof of an accident.

If you read I am in the situation where I have absolutely no damage so it doesn't look like I caused any accident, but am getting charged with making an unsafe lane change.
