State farm...at fault compant was progressive. I wouldnt base state farm on this one...its been an odd time with a lot of shit involved.

Here is what I don't understand. You say the value of the damage has to be 75%. That is determined before money is put into repairs. They should never ever ever start repairing it and then decide to total the vehicle.

So you are saying that they paid around 14K in repairs and are now going to cut you a check for another 20K for the price of hte car.

So you are saying that they spent 34K on the CLS.... There is no magic 75% number when they decide to repair it. ONce they invest the money, they dont stop if the costs run over.... I just don't understand it.

The way it works is they get the value of the car at the time of the wreck from nada.com. That was 20,800. They took 75% of that # and made it the total #....thats around 15,500. If at ANY point in time you hit 75% in repairs by law they have to total it.

Now when it went to progressive (at fault ins co) they hit the 10k limit the driver had so it had to go to my ins co. The next body shop said 10,500 in repairs (low balled to get the job)...thats not enough to total it. They put oil in the car started it up and it did that fine. So at that time the motor was not an issue. The shop finished the repairs that totaled 12k...at that same time the check engine light comes on. While dicken around with that, the ins co paied the body shop for there work (12k). Since I didnt give up and put up a fight and proved there is a problem with the motor the cost of repairing the motor (7K) added to the 12k puts it over the 75% mark. NOW THEM BITCHES GOTTA PAY!!!!!!!!! 20,800 to me. Now its up to them to get there $ back out of the at fault ins company and or the family driving the other car.

I dont think we need to lock this thread...we need to keep it open so no one just lays down to what the ins co says...if your right keep fighting and it will work out...ther were many times I could have takend the fat one up the poop shoot but I didnt. Now I am getting what I deserve....over 20k in cold hard cash!!!!!!!!!

Now the GT is paied off along with the blower!!!!!!!!!!!

I never heard of an insurance company like this. And according to the law, it does not say that 75% is guaranteed its totaled. That means that they will ahve paid out 20K to you and then 15K in repairs

What insurance company would put 15K into repairs and then decide to junk it and pay you out the FMV.

Bull Shit. They paid 35K for a 20K car.....

Here....thats the law...75% in damages = a totaled car. No matter when it hits the 75% mark. The ins co didnt want it to work out this way...but it did. Had the check engine light been a issue from the get go they would have never started to fix it and would have totaled it then. But because of the nature of the problem it went unknow till it was too late.

yeah, i think the problem wasn't totally state farm. i think it was a combination of the other drivers insurance and the bodyshop that repaired the car. i've had state farm since i was 16. i've been in 11 accidents. only 1 was my my fault. i have been in four accidents with uninsured drivers. state farm has never given me a problem at all.

Im glad you finally won and stuck it to the man and didn't get it stuck to you. Way to hold out for what you deserved and not just settle for a car that was never going to be right. If you move to Lafyette soon I wanna see the stang with the blower. I live in Dallas but im out in Ruston, La on business for a few weeks. By the way if you want some protection for from the cops while driving that stang the way its supposed to be driven I reccommend the rmr c450 radar and laser detector and scrambler from rocky mountain radar. I bought it since I new I'd have to be between here and Tx for the next few weeks and it works like a charm. Two days ago I drove by the La. State police doing 100 in a 70 at 2.a.m. on my way back down here and he didn't even come after me. He waw sitting in the grass with his lights off clocking people too. Just a friendly tip.

Well its oficial like a referee with a wistle...they are going to total the car and give me the price at the time of the wreck. So I would bet by weeks end i'll have a check for 20,800 or something in that range. Hell....yeah....its about fuken time!!

I will have some stuff to sell I think too. Comptec headers springs sways, hks exhaust and a Newspeed stb.

After just looking at CT's website I think that mutha fuka at the body shop charged the ins co for the ct sway bars and didnt put one on there. My front one is silver....can anyone confirm are the new ct sways black or silver??? That mutha fuker

The latest CT sways are black. The older ones were silver.

How late is the latest...this would have been changed around july/aug of 05.


I got the original sways back in 03...I could have sworn they were black like the stockers? But now my front one is silver and the back is black.

WELL I TALKED TO THE TOTAL LOSS DEPT.

Its final...they are totaling the car...my 20,800 figure was off...its 20,300 BUT I didnt realize they include tax title in lic so they are giving me 22,169.00!!!!!! They also are willing to give me another 1000 for the performance parts on the car so they would cut a check for 23,169....holey shit!!!!

Now a guy at acura wants to buy the car from me for 1k over salvage and I asked about that price....its 8k...they want 8k for the cl now LOL!! I will tell the guy its got to be 1k over for the parts too so if he gives me 10k ill do that. Then ill net 24,169 out of it.

I cant believe its finaly totaled....if they would have just listened to me in the first place!

And yes thats the best news I have had with this deal in a long time! I actualy might recoup my ins $ I have been paying this whole time. The Ins co might give me some of that $ back as well!
