got hit

Got my TL ass kissed by a spanking new Inifiniti FX45 this morning TWICE in fast sequence - boom, boom !
This happened in bumper-2-bumper traffic @ about < 5 mph.
the guy claims the FX45 didn't responde to his hitting the brake.

The only visible damage is light scratch on the rear bumper by his front plate. Color of the plate was like rubbed in. Bumper is stll aligned in place.

question:
Never got hit b4.
Should I bring the car in to a mechanic or dealer to have a look at ?
Maybe something I don't see ?
What is the max force (mph-wise) the bumper can take ? Does the MASS of the car matter in how bad damage is ?
What is the minimum impact (mph-wise) one can "shrug-off", if any ?
I didn't call cop, was that stupid of me ?

thanks

Some insurance companies won't back you up without a police report, FYI. My sister discovered this problem.

Ask for cash... (bank check).

Personally, I'd make the insurance company deal with the FX45. The guy might not feel like paying once the bill comes in.

There may be a bunch of damage hidden under the bumper you can't see until the cover comes off. It can quickly add up to a couple grand.

Plus testing showed that the TSX is expensive to fix in an under 10 mph collision.

well, the good thing is that since you're both geico, you're probably not going to have that "our people are still negotiating with their people" delay. i agree, the vehicle should be inspected because you never know. hopefully, you can get this resolved with little or no pain.

it depends on some states. e.g. in california, police won't come to the site unless there's injury, public property damage, or traffic obstruction. hmmm, that reminds me, i need to find out the rules for texas.

hey miner, how'd you get that user name? is it because of utep? btw, i'm up in cypress. are we ever going to have a houston meet?

spoke with FX45 guy this afternoon. Said he called dealer before he took the commuter train, and they dispatched a tow truck to tow the FX45 back to Service. Dealer thinks it's ABS failure.

To me, that's not a good reason...

People should know what to do if ABS fails. Plus, if it was ABS failure, wouldn't the little light on the dash come on? I say this guy is just covering up for his own stupidity.

But that's just me...

Still can't deny Ghosn performed a virtual miracle. Of course, when you're cutting costs that much and releasing that many new models, you gotta sacrifice something...
