So I'm getting out of the club at 2am. I give the valet guy my ticket. After 20 mins of waiting, I hear that my car gets into an accident, and the moronic valet guy crashes my car into a WALL....AND DRAGS IT FOR ANOTHER 50 FEET!
Instead of being apologetic, the manager of the valet service BLAMES THE ACCIDENT ON ME!! I'm so fuckin furious, I'm beyond words!
This happened @ Club Shelter in Hollywood. NEVER EVER LET ANYONE VALET YOUR CAR THERE!

it hurts so bad to look at that poor rim. they shouldnt be using your remote start anyways. it is not there car they would loose any court case so I am sure they would settle if you tell them you are going to sue or take them to court.

I don't agree. As long as the valet company's employee had possession of your keys and car they are responsible for any negligent actions that would result in damage to the car. If by pushing the remote start (knowingly or not) they through no fault of your own are responsible. You would most likely win this in court. Ignorance has never been an excuse that you can use in court in this country.

To my knowledge, to get a legal remote start install on a manual car, there are a few safety things you must do to SET THE CAR UP TO BE STARTED, Every time.
1: Put car in neutral, nothing touching pedals, handbrake on.
2: With car still on, press and hold a combination or single button on the remote start key-fob.
3: remove key, exit car, press button to lock doors which in-turn stops the car from running, thus the car knows that once it's started again, it won't go anywhere (its in neutral and parking brake on, doors closed.). If any door is opened, the system should not allow the car to start with the key-fob until the above procedure is repeated.
So, unless they actually drove your car into a wall (likely!), or the system completely fubar'd and for some unknown reason they used the remote start on the car (why?), then I think you have a case against them.
The damages are gonna be pricey by the looks of it. SUE.

By installing a remote start in a manual car, you would've already bypassed a main safety feature (namely the clutch) when starting the car. And yes, the car does move some distance with the starter and in gear. I was in a friend's Prelude with his clutch bypassed. He started the car forgetting that he has left it in gear, we were yanked forward a few feet before he stepped on the clutch to stop it. Also, if there is a slight decline then the car would really be rolling. Your best chance to claim insurance is prove negligence on the parking lot somehow.
So are you trying to tell me that "If" in fact it was a remote start issue, the remote start could get the car to move fast enough to do that much damage to the rim? I don't think so!!! No way in hell! I say the Valet guys were tryin to drift your car in the parking lot and curbed it! You had to be moving pretty goos to curb a wheel that bad!!!
I don't think that you have to prove anything other than the damage happened while the car was in the company's possession. However it happened it got damaged while they were responsible for it.

That is how I feel whenever there is a thread of a parking lot hit and run or a messed up situation like this. I get pissed like it happened to me.
Damn, I hope everything goes well for you and you get all damages settled and paid for... What they did and their excuse is unacceptable... I agree with other members when they say it pains me when they look at the damages even though its not our own car... You have one of the nicest SSM TSXs... Once again, hope everything goes smoothly
Actually, I've seen a Toyota P/U with a remote start left in gear pull thru the ebrake and hit a house hard enough to cause major damage to the stucco and the front end.
It sounds like they didn't yank on the ebrake real hard...

Don't type a letter, call them. But before you do, get all of your facts on paper so that you can refer to your notes for details. Make sure to document the date, time, names of those involved (get the name of the valet and his manager, if you remember). When you decide to call the insurance company, ask them about their take on the situation. You may end up having an insurance adjuster and attorney on your side to get you car fixed. This is only after you've used your collision coverage. They will try to recoup the money through a process called subrogation.
Additionally, see if you have a valet slip/receipt. On the back of most of these tickets/receipts is an "agreement". If you still have that, take a look at it and see if there's any language about liability, etc. Ultimately, I agree with most on this thread. Regardless of whether or not you have a remote start mechanism in your car, you left your car in their care. The accident and damages occured under their care, therefore they should have some sort of liability in the damages caused to your car.

loxllxol, You really should install a toggle switch to the remote start so you can turn it off when you valet park the car or put it in for service. Its an easy install and it can really save your ass from situations like this. What kind of remote start do you have? I have a Viper system, all the remote starts from DEI have a toggle swich for this purpose. But there are some lazy installers out there that dont install it.
