sad day please advise

sad day please advise


Today in the parking lot some guy backed into my TSX and damaged:
1- The side of my front fender right next to the headlights
2- The side of the oem front body kit
3- Scratched my after market wheels
4- Messed up the lining (black plastic cover) above the tire

At least the guy admits that its 100% his fault.
Before I call his insurance, please can someone advise me if his insurance will cover my oem front body kit and the after market wheels

everything that was damaged will be covered and replaced...all they need to do is look at the wheel make/model and buy a brand new one

actually, i'm not so sure insurance covers 'custom' parts. based on my past experience, car insurance usually covers the car in stock form. the price you get for a wheel, for example, will be the price it takes to replace a stock wheel, not a aftermarket wheel.

when i got into an accident in my old car, i had to replace my custom grille - the other person's insurance only paid the stock oem grille value. we're talking $300 difference!

i'd check with your insurance AND their insurance to see what they do/do not cover.

I don't claim expertise on this, but my experience is that the answers to you're questions are directly related to where you are. Most of this stuff varies (sometimes allot) state by state (and by the company). And by the way, the only real answers to your questions will come from whatever insurance company you have to deal with. Anything here will be anecdotal hearsay.

The wheels arent necessarily custom, they are aftermarket. If it was a custom grill, how can they replace that if you did the work? They should repair and replace anything that was damaged. My buddy has an STi with Work Emotions, coilovers, front lip, which all got hit, and he had it all replaced.
But check with insurance, you should have everything replaced.

ouch that sucks. i had a fully modded CRX, and insurance gave me value for all of my aftermarket parts. it was allstate insurance, though

I went through the same thing with my insurance company. Guy hit me and we both had the same company. There was no police report made so I called the insurance company to get my car fixed. It got fixed but when I got in a second accident they cancelled my policy. 2 within a year and neither was my fault.

My point is do your homework first and make sure that its not being processed on your insurance policy.

They will cover all the custom parts.

Yeah, I talked to my agent (a friend) and he told me that they do cover all aftermarket parts. btw, I also have allstate so I'm not sure about others.

sorry fellas - i use the term "custom" and "aftermarket" interchangably tho there is a difference. i had an "aftermarket" JDM grille. STATE FARM only paid $150 or so, which is the price of the oem grille. the JDM grille cost me over $400 to buy/ship/paint... the inspector said at that time they do NOT cover aftermarket parts; maybe that's changed recently. so ya'll should double check wif your insurance companies to make sure they do cover aftermarket parts. get it in writing and make sure they have an itemized list of your aftermarket parts your policy covers.

Thank you every one

There is a deep 1 inch scratch on my aftermarket wheel
The wheel does not look bent, but the the paint is chiped off (about 1 inch)

Please can someone advise me if the insurance will buy me a new wheel or they will just fix it with some paint

well try to get them to cover the wheel. even if they low ball you it may be enough to get it professionally repaired.

We can't tell you what will happen, what the insurance company will handle, without a really good crystal ball.

Have you talked to YOUR insurance company? Most that I've had want to know about any incident even if you're not at fault and the other driver's company will cover. If nothing else, having your insurance company involved to look out for your interests might be an advantage. YMMV of course.

also, when you get your insurance, you tell them any things you've added to your car. if you didn't identify them, then you won't be covered. most likely at least. (the idea is, they're going to charge you more for something that is more expensive to insure)

When another person is at fault in an accident, their insurance carrier is responsible for repairing your vehicle, whether or not you have factory/aftermarket/custom accessories installed, that were damaged in the accident. As to your own policy.....it varies by insurance carrier and by the state where where you reside. If the custom/aftermarket part costs the same as the factory part, yes you are covered. If the custom/aftermarket part costs more than the factory part, you may or may not have coverage for the increased cost. Some car insurance policies completely exclude the increased cost of custom/aftermarket parts and other policies include a nominal sum, such as $1,000 or $1,500. If you need additional coverage, you must declare and pay an extra premium for those items. The reason carriers do this, came about 30 years ago when custom vans were created with wild paint schemes, porthole windows, and customized interiors. In the past few years, it has been limited due to the fact many kids put a $5,000 stereo system into their $3,000 car.
