One month old Lemon

One month old Lemon
I should have done my research prior to buying an Acura as I gathered some persistent issues with Acuras.
I bought a new 2012 MDX on June 1st and on June 2nd I started hearing a creaking sound in the second row. Took it to the dealer on June 9th and since then they have had it trying to figure out what the issue is.
They called me 4 times saying they fixed it but when I went on test drives with their technicians the issue is not fixed. I contacted Acura HQ for a replacment considering that the darn car is 29 days old and has been in the shop for 22 days. They assigned a case manager but the case manager says that it is still only on the second Repair Order and unless the dealer closes it, they can not determine if it qualifies as a lemon.
A brand new $50K car in the shop for the first month. Dont I have a recourse? Do I just have to put up with a faulty product manufactured by Acura?
Appreciate any thoughts and experiences on how to handle this.

Now, I think that you need a little more than a "creaking" sound to get a car replacement. I am no suggesting that there is not an issue, just that you need to find out what it is before just asking for a new car. A friend on the RDX board had a lemon because some welds in the A pillar were defective (or something like that) and he would hear a "noise" all the time. They removed the trim and found out what it was, he got a new one......
I don't understand your comment about "doing the research". Lemon cars occur in every brand, and Acura is not exempt from it.

Thanks for your thoughts! The warranty manual suggests we contact Acura and file a case with the BBB. The problem is that after 22 days in the shop the Acura dealer is not able to figure out what the problem is.
It would have been a different issue if I had driven the car for 6 months, 3 months, 1 month, 1 week. A faulty product right off the bat and I have to be stuck with it.
Interesting your brought up the welds in A piller in the RDX becuse the following for a TL had the same issue.

Agree that it is not the case with Acura but atleast they should be taking accountability for a brand new one.

Got the car back after 21 days at the dealer repair. Was sound free for a day and the sound back on. Acura HQ not helping either. Talking to a lawyer and BBB. What a waste...

Are you the only one that hears the sound or are they able to hear it? Please keep updating this post to know what the end result is....off course best of luck to you fighting this.

Good question
. They hear it too. Since this started, test drove with 3 technicians and one master technician and they all hear it. Service manager hears it as well. Will keep updating. Need all the luck fighting them.

Hey if I paid $50K (which I did for mine) and I had some unbearable creaking noise, I'd be pissed too. One can reasonably expect a car this expensive to be free of defects. Manufacturers pay very close attention to their rate of defects to adjust manufacturing techniques.

If the sound cannot be corrected he should...someone in the RDX board had missing or defective welds and the car had a "sound", they discovered the problem and the car was determined a lemon

$50k is a lot of money.

Ask the dealer to supply you with an MDX loaner and let the dealer take their time. Like 99% of issues, it won't take that long to fix it. Most of the time the car is just sitting there waiting for someone to work on it. Meanwhile you can rack up some miles on their car and that generates motivation for them to fix it.
