Speeding Summons FDR Drive

I really don't understand how a cop hands you a ticket with no evidence of you speeding (I was maybe doing 50-55 in a 40, but there was only 2 other fucking cars on the road on a fucking highway... Yes the speed limit is fucking 40 on a fucking 3 lane highway that's just how it is, don't ask)

Secondly, I need some advice. I'll probably fight this ticket because 6 points is retarded to take in the ass without any resistance. It's like handing them the fucking lube.

Now I need your advice, I know you guys have been in my situation, but this is my first speeding summons. On the ticket it says I was going 67 in a 40 (complete bullshit, I was following a broken piece of shit pre99 corolla that's falling apart, next to a faggot driving a bmw 5series like it was a race track) On the ticket, it says he started out following me on houston st for roughly 400 feet before he decides to give me a ticket(He basically took my license, came back with a summons and booked it)

Now some fucking math... 67MPH is fucking roughly 98 Feet per second. Besides the fact that he came up my ass like a bullet coming out of a sniper rifle. Following me at 98 feet per second at a distance of 400 feet is fucking 4 seconds. No there was no radar gun, and there was obviously no pacing. Just because he reached speeds of 67mph (and this guy came up QUICK on me) Doesn't mean I was near that speed.

What do I say to the judge when the time comes? It seems like any cops word is fucking gold compared to the citizens. My defense is basically... NAH NO WAY I WAS GOING THAT FAST, SHIT DOESN'T EVEN MAKE SENSE IF YOU DO THE MATH.

Got caught by a white unmarked charger...

First dress up nice and be respectful. Then, just get a lawyer or fight it yourself, it seems to me that you worked out the math and it doesn't add up. I don't see why it wouldn't be thrown out.

I'm just mad at how disrespectful the highway patrols are. Why the hell are they always decked out in leather. Who the hell wears leather pants?

Damn.. that sucks.. looks like you know what you're talking about in terms of the math. I'd say fight it off and because he didn't have a radar gun, he doesn't have proof or anything like that.

It's surprising that you got a speeding ticket on the FDR. I usually never see any highway patrols down there. Most cops are worrying about other stuff.

Good luck with everything though!

if the cop didnt get you on radar then it isnt legit. i went to court about 6 months ago for speeding on the belt parkway[76 in 50]. went to court, cop got me since they had radar info and wrote down the entire scene on the day. they had evidence on radar is the officer's only defense. i say fight it, your cop didnt have any way of clocking you, so its your words against theirs. the judge will listen to you.

Something similar happened to me on the southern state heading east. I was doing over the 55 I was cruising at about 70 it was 1am sunday night highway was empty. I see a car behind me to my right I'm in the middle lane I pay it no mind few seconds later he zooms up to my ass and lights go on. He gave me a summons but didn't write how fast I was going he used some word on it and I asked what it meant he said "basically means I didn't like your driving speed, go to court it will be dismissed" Sure enough dismissed and $200 fee. I was polite to the cop and he wasn't an A-hole either. Guess village of hempstead need 200 bucks. Bastards, beats points thou. Go fight it and ask for radar proof. Like others said be polite and composed. You already sound like you know your stuff. Good Luck!

You will be surprised, once I went to court to translate for my uncle who drove a livery cab. He got a ticket for running a light he admitted to me he was guilty but wanted to fight it anyways. We get called up judge asks for the cop's account of the event. Cop states he was parked on so and so street when he sees my uncle cross in front of him. He tells the judge his light was green so my uncle took a red light. Judge then asks if he went with the motorist and check if that light was working, cop says no judge says case dismissed. We didn't have to say one word except thanks and have a good day your honor, cops face was priceless LOL. So you never know.

Damn cross island?? Gotta watch my back now!!

Spend some money and get a lawyer. Trust me. I was on the clearview and mofo clock me doing 72 on 55. I had 2 pba card and mofo still wrote me a damn ticket. He even wrote " LASER" on the ticket. I got myself a laywer and I didn't even have to show up for the hearing. My lawyer called me later on that day and told me case was dismissed.
Best $300 I ever spend.

i drove up to Yonkers yesterday and i saw people getting pulled over left and right the whole way up there from out on LI. i heard they increased their patrols to crack down on DWI/DUIs but i think the cops are just pulling people over for anything now.

good luck with this Rejckt. lawyer up.

Yeh, right before the Union Tpke exit going towards the Belt....I saw the cop, he was visable but I didn't think much of my speed since I was in the far right lane and just minding my business while others were flying by in the other lanes.

Can you PM me lawyer? I don't even know if I have a chance at winning this since it was by laser.

To the OP..

Was your summons on a pink or yellow ticket?

Got written a pink ticket earlier this year for "posted limit / excess of 30 mph" on northern blvd and was required to make a court appearance. Appeared at the court house and was handed 3 pieces of paper, two of them were copies of my summons front and back, and the third one stated that my summons was dismissed because of legally insufficient evidence or something like that. Did not even have to see the judge.

Btw the cop that wrote me the summons was an asshole and full of shit. He basically sped up behind me and wrote me a summons for "posted limit / excess of 30 mph". He said I was doing 80 and then said he had to do 80 to catch up to me. Did not pace me or use a radar gun. I was going 40 mph.

I wish you best of luck on your summons and hope it turns out like mine.

I got a yellow ticket because it wasn't over 31mph. I am 95% sure that I will win the dispute, but this doesn't change the fact that I have to take a day off work to get this shit taken care of.

The NYPD's retarded for having quotas... seriously, how can you force cops to give tickets / make arrests. That's just unethical .

NYPD Highway cops are like State troopers( or atleast they think they are ) If that little box is checked of on the ticket that say RADAR or LIDAR then im sorry but you will not win in court... but hey its worth a try but if you have ever been in traffic court you will know that the judge doesn't give 2 shits about the person and what the police officers are trained to say at the beginning of your traffic hearing will just Bury you.... Im not trying to be a dick it is very possible you can get it lessened but in New York City those highway cops will not lose in court... Best of luck to you I hope everything works out because i wouldn't want anyone to get points on there license who doesn't deserve them.

If he didnt use radar you ill win in court... Best of luck

If you've ever been on the FDR, you'll know that you can't be hit with a LIDAR. LIDAR has to be used stationary and there are very few places with a safety zone for a cop to be planted in. A radar, has a large range and if a cop RADAR'd you while moving, you can say he got someone else.

Lol ive driven on the FDR and yes you are correct there are very few places where it can be run and it would be a safety issue, I was using it as an example just checking the boxes, you mentioned that someone was driving next to you who thought he was on a track, could have clocked him and just pulled you over... just get a lawyer for under 1000 bucks and just get it taken care of you wot even have to go to court

Going north??...67 on that section of the FDR is flying.... only place that 60+ is "safe" is going south coming up on the Brooklyn Bridge.... the cop just made up a random # and gave you a ticket without actually thinking how fast that really is on that road... fight it!!!!! If the judge drives the FDR... he will look at the ticket and laugh....... then he will ask what other tickets did you get?

if you were truly going that fast you would have gotten slammed with a reckless driving too

if you were driving up north fdr on the part that goes under the brooklyn bridge the speed limit there is 40 mph, i got a ticket their. there is usually two cops on foot with a radar gun taking turns pulling people over. possibly the other cop caught you on radar and called it in?

Doing 67 in a 40 zone is not reckless driving. Did 91 in a 55 zone once and got pulled by a NYS trooper. No reckless driving, just speeding. I think you have to be 40 over the posted to be considered reckless I think. Don't remember from the research on that incident as it was a long long time ago.

I got a lawyer to deal with this. I was going SOUTH towards the Brooklyn Bridge.

@KingMeow: Spoilaz is trying to say that 67 on the FDR @ 1 PM on a city gridlock alert is near impossible unless I'm driving like I robbed a bank which I wasn't (middle lane gear4 3k rpm 6mt) And just to think about it, I was in the middle lane... the lane where everyone likes to cut the line on the brooklyn bridge wait. So I really couldn't do 67 without rear ending someone.

theres no comfortable ride at 67mph on th FDR thats bs, fight it, wait a day or two before the court date, then reschedule, make his ass go spend the day at the court house. you can reschedule up to 2x. the third time, you have to show. also, after the first reschedule, they dont show for the second court date, which becomes in your favor and gets throw out.... Good Luck.
