Seems like the Brawn's have run out of steam, and the other teams have caught up with the Brawn's.

The Renault F1 Team will be racing in the European Grand Prix in Valencia this weekend after their suspension was overturned by a FIA International Court of Appeal after a hearing in Paris on Monday.

The team had been banned after the Hungarian Grand Prix when the team allowed driver Fernando Alonso to leave the pits during the event with a loose wheel that eventually flew off the car.

Officials said they felt that the team had released Alonso and knew the wheel was loose thereby creating an unsafe condition. They also accused the team of not informing the driver there was a loose wheel.

Monday in the hearing a lawyer arguing on behalf of Renault said there had been no conscious wrongdoing on the part of the team and the two mechanics that dealt with the wheel simply didn’t have time to inform the rest of the crew or the driver prior to him leaving the pits.

The lawyer, Ali Malek, told the panel of four judges that the incident did not "deserve more than a reprimand" and that bans should be reserved for things like cheating.

"The only persons who knew ... were the two mechanics," said Malek. "Nobody on the pit wall knew there was a problem and the driver did not know either."

A lawyer representing the FIA however, Paul Harris said attributing the knowledge to mechanics does not absolve Renault of blame.

"(They) are employed by the team and their knowledge must be attributed to the team," he said.

"Renault cannot simply rely on their flawed procedures to say they could not communicate ... Two wrongs don't make a right."

In a statement issued Monday afternoon, the panel of four judges decided, "to allow the appeal and overturn the sanction imposed by the stewards"

A fine of $50,000 and reprimand was issued to replace the race ban

Statement From the FIA International Courtof Appeals

On 26 July 2009, the Stewards of the Meeting suspended the competitor ING Renault F1 Team (“Renault”) from the next event in the 2009 Formula One World Championship (namely, the Grand Prix of Europe to be held in Valencia) for the following reasons:

- Renault knowingly released car N°7 (driver Fernando Alonso) from the pit stop position without one of the retaining devices for the wheel-nuts being securely in position;

- Being aware of this, Renault failed to take any action to prevent the car from leaving the pit-lane;

- Renault failed to inform the driver of this problem or to advise him to take appropriate action given the circumstances;

- This resulted in a car part detaching at turn 5 and the wheel itself detaching at turn 9.

The FFSA appealed the Stewards’ decision on behalf of Renault.

Decision

Renault admitted to the Court that it breached the Sporting Regulations, in that it failed to ensure that car no. 7 complied with the conditions for safety throughout practice and the race, and that it released the car after a pit stop when it was unsafe to do so. However, it requested the Court to reconsider the severity of the sanction imposed by the Stewards.

Having heard the arguments of the parties, the Court has decided as follows:

1. To allow the appeal and overturn the sanction imposed by the Stewards in the Contested Decision;
2. To issue a reprimand and impose a fine of $50,000 upon Renault.

The reasons for this decision will be published in a full judgment in the coming days.
This should have been just a fine from the beginning.

I'm really happy for the people of Spain so they get to see their hometown hero race this weekend. Sometimes the FIA does get it right!
