In fact, a couple of times I have purchased a game on eBay (go figure ) but it was scratched or didn't play for some reason, and I have gone to the local GameStop, explained that to them and asked if I could swap it out for a new and working one, and they have done it. They typically open the new one so it can't be returned as new... but they have done that for me. Best Buy did it for me once as well... and on a game that I scratched b/c I moved the system, but did not buy from them.

So if stores are willing to do that when they KNOW the item was not purchased from their store, then buying an item and returning the same exact item containing all of the correct parts (except the defective console) in a box where the console and box serial numbers match cannot be illegal.

Immoral? Yes, but that's subjective. Illegal, I'm leaning towards no.

Took the third one back and found one with a 6-19-06 mfg date. Took it home and all is well, other than I forgot to swap my old hard drive. Oh well, I'm just glad to have a system back.
